(a)CERTIF I CA TI ONR E QU IRE D.—TheUnd e rS e c re t ar yofD efen s e for A c qui sition , Techno l o g y, and L ogistics shall certify to the congressional defense co m mittees that the Armed Reconnaissance H elico p ter has— ( 1 ) satisfactorily b een certified under section 243 3(e)(2) of title 1 0 , United States Code

(2) been restructured as an acquisition program by the Army; (3) satisfactorily completed a Limited User Test; and (4) been appro v ed to enter M ilestone C. (b) RE S TRICTION ON OBL I G ATION OF F UNDS P ENDING CERTIFI - CATION.—Of the amounts appropriated pursuant to an authori z ation of appropriations in this Act or other w ise made available for fiscal year 200 9 for aircraft procurement, Army, for the Armed Reconnais- sance Helicopter, not more than 20 percent may be obligated until 30 days after the certification required by subsection (a) is received by the congressional defense committees. SEC. 11 5 . STR YK ER MOBILE GUN SYSTEM. (a) LI M ITATION ON A V AILABILIT Y OF FUNDS.— N one of the amounts authorized to be appropriated by this Act for procurement of weapons and trac k ed combat vehicles for the Army may be obligated or e x pended for purposes of the procurement of the Stryker Mobile G un System until the Under Secretary of Defense for Acquisition, Technology, and Logistics submits to the congres- sional defense committees a written certification that the Under Secretary has approved a plan for the Army to mitigate all Stryker Mobile Gun System deficiencies. (b) RE P ORTS REQUIRED.—Not later than 6 0 days after the date of the enactment of this Act, and every 1 8 0 days thereafter until December 31, 2011, the Secretary of the Army, in consultation with the Director of Operational Test and E valuation, shall submit to the congressional defense committees a report on the status of actions by the Army to mitigate all Stryker Mobile Gun System deficiencies. Each report shall include the following

(1) An explanation of the plan by the Army to mitigate all Stryker Mobile Gun System deficiencies. (2) The cost estimate for implementing each mitigating action, and the status of funding for each mitigating action. (3) An inventory of the Stryker Mobile Gun System vehicle fleet that specifies which mitigating actions have been imple- mented. (4) An updated production and fielding schedule for Stryker Mobile Gun System vehicles required by the Army but not yet fielded as of the date of the report. (c) W AIVER AUT H ORITY.—The Secretary of Defense may waive the limitation in subsection (a) if the Secretary— (1) determines that continued procurement of Stryker Mobile Gun System vehicles will provide a vital combat capa- bility to the Armed Forces; and (2) submits to the congressional defense committees written notification of the waiver and a discussion of the reasons for the determination made under paragraph (1).
