C . 7713(9)). SEC.5 5 2 . IMPA C T AI DFOR C H I L DRE NW ITH SE V ERE DISA B ILITIES. O f the amount authori z ed to be appropriated for fiscal year 2009 pursuant to section 301(5) for operation and maintenance for Defense-wide activities, $5,000,000 shall be available for pay- ments under section 363 of the F loyd D. Spence N ational Defense Authorization Act for Fiscal Y ear 2001 (as enacted into law by P ublic Law 106 – 398

11 4 Stat. 1654A–77; 20 U.S.C. 7703a). SEC. 55 3 . TRANSITION OF MILITAR Y DEPENDENT ST U DENTS AMON G LOCAL EDUCATIONAL AGENCIES. Subsection (d) of section 574 of the J ohn W arner National Defense Authorization Act for Fiscal Year 2007 (Public Law 109– 364; 120 Stat. 2227; 20 U.S.C. 7703b note) is amended to read as follows

‘‘(d) TR AN S ITION OF M ILITARY DE P ENDENTS A M ONG LOCAL EDU- CATIONAL AGENCIES.—(1) The Secretary of Defense shall wor k collaboratively with the Secretary of Education in any efforts to ease the transitions of military dependent students from Depart- ment of Defense dependent schools to other schools and among schools of local educational agencies. ‘‘(2) The Secretary of Defense may use funds of the Department of Defense Education Activity for the following purposes: ‘‘(A) To share e x pertise and experience of the Activity with local educational agencies as military dependent students make the transitions described in paragraph (1), including transitions resulting from the closure or realignment of military installa- tions under a base closure law, global rebasing, and force restructuring. ‘‘( B ) To provide programs for local educational agencies with military dependent students undergoing the transitions described in paragraph (1), including— ‘‘(i) distance learning programs; and ‘‘(ii) training programs to improve the ability of military dependent students who attend public schools in the United States and their teachers to meet the educational needs of such students. ‘‘(3) The authority provided by this subsection expires Sep- tember 30, 2013.’’. SEC. 55 4 . CALCULATION OF PAYMENTS FOR ELIGIBLE FEDERALLY CONNECTED CHILDREN UNDER DEPARTMENT OF EDU - CATION ’ S IMPACT AID PROGRAM. In fiscal year 2009, section 8003(a)(2)(C)(i) of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7703(a)(2)(C)(i)) shall be applied by substituting ‘‘5,000’’ for ‘‘6,500’’.
