(b) TERMINAT I O NO FAU T H ORIT Y . — Section 15 9 9c(c) of such title is amended— (1) by inserting ‘‘(1)’’ before ‘‘The authority of’’; ( 2 ) by stri k ing ‘‘September 3 0 , 2010’’ and inserting ‘‘Sep- tember 30, 2012’’; and (3) by adding at the end the following new paragraph

‘‘(2) The Secretary may not appoint a person to a position of employment under subsection (a)(2) after September 30, 2012.’’. SEC.1 1 08 . DIR EC TH IRE AU TH O RIT Y AT P ERSO N NE L DE M ONSTRATION LA B ORATORIES F OR CERTAIN CANDIDATES. (a) AUTHORITY.—The Secretary of Defense may appoint quali- fied candidates possessing an advanced degree to positions described in subsection (b) without regard to the provisions of subchapter I of chapter 33 of title 5, U nited States C ode, other than sections 3303 and 332 8 of such title. (b) A P P L I C A B ILITY.—This section applies with respect to can- didates for scientific and engineering positions within any labora- tory identified in section 9902(c)(2) of title 5, United States Code. (c) L IMITATION.—(1) Authority under this section may not, in any calendar year and with respect to any laboratory, be e x ercised with respect to a number of candidates greater than the number equal to 2 percent of the total number of scientific and engineering positions within such laboratory that are filled as of the close of the fiscal year last ending before the start of such calendar year. (2) F or purposes of this subsection, positions and candidates shall be counted on a full-time equivalent basis. (d) E MPLOYEE DEFINE D .—As used in this section, the term ‘‘employee’’ has the meaning given such term by section 2105 of title 5, United States Code. (e) TERMINATION.—The authority to make appointments under this section shall not be available after December 31, 2013. SEC. 110 9 . STATUS REPORTS RELATIN G TO LABORATORY PERSONNEL DEMONSTRATION PRO J ECTS. Section 110 7 of the N ational Defense Authorization Act for Fiscal Y ear 2008 ( P ublic Law 110-181; 122 Stat. 357) is amended by adding at the end the following: ‘‘(e) STATU SR EPORTS.— ‘‘(1) IN G ENERAL.—Not later than 4 5 days after the date of the enactment of this Act and not later than M arch 1 of each year beginning after the date on which the first report under this subsection is submitted, the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and H ouse of Representatives a report providing, with respect to the year before the year in which such report is submitted, the information described in paragraph (2). 10USC2358note. 10 USC 1580 note.
