12 2 STA T .46 24 PUBLIC LA W 11 0– 41 7—O CT. 14 , 200 8‘ ‘ (1)GUIDANCER E Q UIRED .—TheS e cr e ta r yofD efe ns e sha l l d e v elo p and i ss u e g uidance on the procedures for the use of the authority in this section. ‘‘( 2 ) MO DI F ICA T ION.— I f the Secretary m odifies the guidance issued under paragraph (1) , the Secretary shall su b mit to the appropriate committees of C ongress a report setting forth the modified guidance not later than 30 days after the date of such modification. ‘‘(f) A NNUA LR E P ORT.— ‘‘(1) REPORT REQUIRED.— N ot later than O ctober 31 fol - lo w ing each fiscal year in which the authority in this section is used, the Secretary of Defense shall submit to the appropriate committees of Congress a report on the e x ercise of the authority during such fiscal year. ‘‘(2) E LE M ENT S .—Each report under paragraph (1) shall include, for the fiscal year covered by such report, the following

‘‘(A) A statement of the recipients of learning content and information technology provided under this section. ‘‘( B ) A description of the type, q uantity, and value of the learning content and information technology provided under this section. ‘‘(g) APPROPRIATE COMMITTEES OF CON G RESS DEFINED.—In this section, the term ‘appropriate committees of Congress ’ means— ‘‘(1) the Committee on Armed Services and the Committee on F oreign Relations of the Senate

and ‘‘(2) the Committee on Armed Services and the Committee on Foreign Affairs of the H ouse of Representatives.’’. (2) CLERICAL AMENDMENT.—The table of sections at the beginning of subchapter I of chapter 13 4 of such title is amended by adding at the end the following new item: ‘ ‘ 2 2 49d.Distr i bu ti on to ce rt a in f orei g n p ersonne l of education and training m aterials and information tec h nolog y to enhance military interoperability w ith the armed forces. ’ ’. (b) GUIDANCE ON U TILI Z ATION OF AUT H ORIT Y .— (1) SU B MITTAL TO CONGRESS.—Not later than 30 days after issuing the guidance required by section 224 9 d(e) of title 10, United States Code, as added by subsection (a), the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and the House of Representatives a report setting forth such guidance. (2) UTILIZATION OF SIMILAR GUIDANCE.—In developing the guidance required by section 2249d(e) of title 10, United States Code, as so added, the Secretary may utili z e applicable portions of the current guidance developed by the Secretary under sub- section (f) of section 120 7 of the J ohn W arner National Defense Authorization Act for Fiscal Y ear 2007 ( P ublic L aw 109 – 3 6 4; 120 Stat. 2419) for purposes of the exercise of the authority in such section 1207. (c) REPEAL OF SUPERSEDED AUTHORITY.— (1) IN GENERAL.—Section 1207 of the John Warner National Defense Authorization Act for Fiscal Year 2007 is repealed. (2) SUBMITTAL OF FINAL REPORT ON E X ERCISE OF AUTHORITY.—If the Secretary of Defense exercised the authority in section 1207 of the John Warner National Defense Authoriza- tion Act for Fiscal Year 2007 during fiscal year 200 8 , the Secretary shall submit the report required by subsection (g) of such section for such fiscal year in accordance with the 120Sta t . 2 4 1 9 .
