(h) TEM P ORAR YA PPOINTMENT S TOT H EA C ADEMY.— (1) I N GENERA L .—Chapter 513 of title 46, United States Code, as amended by section 3513 of this Act, is f u rther amended by adding at the end thereof the following: ‘ ‘ §513 1 6.Tempora r y appo int ment s tot h e Ac a d emy ‘ ‘ N otwithstanding any other pro v ision of law, the M aritime Administrator may appoint any present employee of the United States Merchant Marine Academy non - appropriated fund instrumentality to a position on the G eneral Schedule of comparable pay. E ligible personnel shall be engaged in wor k permissibly funded by annual appropriations, and such appointments to the Civil Service shall be without regard to competition, for a term not toe x ceed 2 years. ’ ’. (2) CONFORMING AMENDMENT.—The chapter analysis for chapter 513 of title 46, United States Code, as amended by section 3513 of this Act, is further amended by adding at the end the following: ‘‘5131 6 . T em p orary appointments to the Academy.’’. SEC.3507 . A C TION STOA D D R ESS SE XU A LH ARASS M ENT AND V IOLENCE AT THE UNITED STATES MERCHANT MARINE ACADEM Y . (a) R E QU IRED P OLICY.—The Secretary of Transportation shall direct the Superintendent of the United States Merchant Marine Academy to prescribe a policy on sexual harassment and sexual violence applicable to the cadets and other personnel of the Academy. (b) MATTERS TO B E SPECIFIED IN POLICY.—The policy on sexual harassment and sexual violence prescribed under this section shall include— (1) a program to promote awareness of the incidence of rape, ac q uaintance rape, and other sexual offenses of a criminal nature that involve cadets or other Academy personnel

(2) procedures that a cadet should follow in the case of an occurrence of sexual harassment or sexual violence, including— (A) a specification of the person or persons to whom an alleged occurrence of sexual harassment or sexual violence should be reported by a cadet and the options for confidential reporting; (B) a specification of any other person whom the victim should contact; and (C) procedures on the preservation of evidence poten- tially necessary for proof of criminal sexual assault; (3) a procedure for disciplinary action in cases of alleged criminal sexual assault involving a cadet or other Academy personnel; (4) any other sanction authori z ed to be imposed in a substantiated case of sexual harassment or sexual violence 46USC5130 1 note.
