(c) E FFE C TI V E DATE.—Subsection (b) of section 1 07 4i of title 10, U nited States Code, as added by subsection (a)( 2 ), shall apply with respect to travel described in subsection (a) of such section that occurs on or after J anuary 1, 200 8 , for follow-on specialty care, services, or supplies. SEC.163 3. R ES PIT EC A REA NDO T H ERE X TENDED CARE B ENE F ITS FOR M EMBERS OF THE U NIFORMED SER V ICES W HO INCUR A SERIOUS IN J UR Y ORI L LNESS ON ACTIVE DUTY. (a) I N G ENE R AL.—Section 1074(c) of title 10, United States Code, is amended by adding at the end the following new paragraph: ‘‘(4)( A ) Sub j ect to such terms and conditions as the Secretary of Defense considers appropriate, coverage comparable to that pro- vided by the Secretary under subsections (d) and (e) of section 107 9 of this title shall be provided under this subsection to members of the uniformed services who incur a serious injury or illness on active duty as defined by regulations prescribed by the Secretary. ‘‘( B ) The Secretary of Defense shall prescribe in regulations— ‘‘(i) the individuals who shall be treated as the primary caregivers of a member of the uniformed services for purposes of this paragraph
and ‘‘(ii) the definition of serious injury or illness for the pur- poses of this paragraph.’’. (b) EFFECTIVE DATE.—The amendment made by subsection (a) shall ta k e effect on January 1, 2008. SEC. 163 4 . REPORTS. (a) RE P ORTS ON IMPLEMENTATION OF CERTAIN RE QU IREMENTS.— N ot later than 90 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the congressional defense committees a report describing the progress in imple- menting the re q uirements as follows: (1) The requirements of section 721 of the John W arner National Defense Authori z ation Act for F iscal Y ear 2007 ( P ublic L aw 109 – 3 6 4; 120 Stat. 2294), relating to a longitudinal study on traumatic brain injury incurred by members of the Armed Forces in O peration Iraqi Freedom and Operation Enduring Freedom. (2) The requirements of section 741 of the John Warner National Defense Authorization Act for Fiscal Year 2007 (120 Stat. 2304), relating to pilot projects on early diagnosis and treatment of post-traumatic stress disorder and other mental health conditions. (b) ANNUAL REPORTS ON E X PENDITURES FOR ACTIVITIES ON TBI AND PTSD.— (1) REPORTS REQUIRED.—Not later than M arch 1, 2008, and each year thereafter through 2013, the Secretary of Defense shall submit to the congressional defense committees a report setting forth the amounts e x pended by the Department of Defense during the preceding calendar year on activities described in paragraph (2), including the amount allocated during such calendar year to the Defense and V eterans Brain Injury Center of the Department. 10USC 10 74note.R e gula t i on s .
