12 2 STA T .8 28 PUBLIC LA W 11 0– 22 9—M A Y 8 , 2008 (1)INGE NE RAL.—TheS e cr e ta r y,in c o n sul tation w ith the m ana g ers o f any F e d eral land within the study area, a p pro - priate State and local go v ernmental agencies, tri b al govern- ments, and any interested organi z ations, shall conduct a study to determine the feasibility of designating the study area as the C olumbia- P acific N ational H eritage A rea. ( 2 ) R E QUI RE M EN TS .—The study shall include analysis, docu- mentation, and determinations on whether the study area— (A) has an assemblage of natural, historic, and cultural resources that together represent distinctive aspects of American heritage worthy of recognition, conservation, interpretation, and continuing use, and are best managed through partnerships among public and private entities and by combining diverse and sometimes noncontiguous resources and active communities
( B ) reflects traditions, customs, beliefs, and fol k life that are a valuable part of the national story; (C) provides outstanding opportunities to conserve nat- ural, historic, cultural, or scenic features; ( D ) provides outstanding recreational and educational opportunities; ( E ) contains resources important to the identified theme or themes of the study area that retain a degree of integrity capable of supporting interpretation; (F) includes residents, business interests, nonprofit organizations, and local and State governments that are involved in the planning, have developed a conceptual financial plan that outlines the roles for all participants, including the Federal G overnment, and have demonstrated support for the concept of a national heritage area; (G) has a potential local coordinating entity to work in partnership with residents, business interests, nonprofit organizations, and local and State governments to develop a national heritage area consistent with continued local and State economic activity; and (H) has a conceptual boundary map that is supported by the public. ( 3 ) PRI V ATE P R O PERT Y .—In conducting the study re q uired by this subsection, the Secretary shall analyze the potential impact that designation of the area as a national heritage area is likely to have on land within the proposed area or bordering the proposed area that is privately owned at the time that the study is conducted. (c) REPORT.—Not later than 3 fiscal years after the date on which funds are made available to carry out the study, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report that describes the findings, conclusions, and recommendations of the Secretary with respect to the study. SEC.482 .S TUDYOF S I TES R E LA TI NG TOA B RA H A M LINCOLN IN K EN - TUCKY. (a) DE F INITIONS.—In this section
(1) HERITAGE AREA.—The term ‘ ‘Heritage Area ’ ’ means a National Heritage Area in the State to honor Abraham L incoln.
