(b) SAN J OSE AREA W ATER RE CL AMATION AND RE U SE PRO J ECT.— I t is the intent of Congress that a comprehensi v e water recycling program for the San F rancisco B ay Area include the San Jose Area water reclamation and reuse program authorized by section 16 0 7 of the Reclamation Projects Authorization and Adjustment Act of 1992 (43 U.S.C. 390h – 5). SEC.513 . BUR E A U OF REC L A M A TI O N SITE SECURIT Y . (a) TREATMENT OF CA P ITAL COSTS.—Costs incurred by the Sec- retary of the Interior for the physical fortification of Bureau of Reclamation facilities to satisfy increased post-September 11 , 2001, security needs, including the construction, modification, upgrade, or replacement of such facility fortifications, shall be nonreimburs- able. (b) TREATMENT OF SECURIT Y -RELATED O PERATION AND M AINTE- NANCE COSTS.— (1) REIM B URSABLE COSTS.—The Secretary of the Interior shall include no more than $ 1 8 ,900,000 per fiscal year, inde x ed each fiscal year after fiscal year 2008 according to the preceding year ’ s Consumer Price Index, of those costs incurred for increased levels of guards and patrols, training, patrols by local and tribal law enforcement entities, operation, mainte- nance, and replacement of guard and response force e q uipment, and operation and maintenance of facility fortifications at Bureau of Reclamation facilities after the events of September 11, 2001, as reimbursable operation and maintenance costs under Reclamation law. (2) COSTS COLLECTED T H ROUGH W ATER RATES.—In the case of the Central V alley Project of California, site security costs allocated to irrigation and municipal and industrial water service in accordance with this section shall be collected by the Secretary exclusively through inclusion of these costs in the operation and maintenance water rates. (c) TRANSPARENCY AND REPORT TO CONGRESS.— (1) POLICIES AND PROCEDURES.—The Secretary is author- ized to develop policies and procedures with project bene- ficiaries, consistent with the requirements of paragraphs (2) and (3), to provide for the payment of the reimbursable costs described in subsection (b). (2) N OTICE.—On identifying a Bureau of Reclamation facility for a site security measure, the Secretary shall provide to the project beneficiaries written notice— (A) describing the need for the site security measure and the process for identifying and implementing the site security measure
