( 2 ) Q UARTERL Y REPORTS ON PERSONNEL AND UNIT READI - NESS.—The amendment made by subsection (b) shall apply with respect to the q uarterly report required under section 48 2oftitle1 0,U nited S tates C ode, for the second quarter of fiscal year 200 9 and each subsequent report required under that section. (d) R EPORT ON I MPLEMENTATION.— (1) IN GENERAL.—As part of the bud g et j ustification mate- rials submitted to Congress in support of the budget of the P resident for each of fiscal years 2009 and 2010 (as submitted under section 110 5 of title 3 1, United States Code), the Sec- retary of D efense shall submit to the congressional defense committees a report on actions ta k en by the Secretary to imple- ment the amendments made by this section. (2) E LEMENTS.—Each report required under paragraph (1) shall include a description of the mechanisms to be utili z ed by the Secretary for assessing the personnel, equipment, and training readiness of the N ational G uard, including the stand- ards and measures that will be applied and mechanisms for sharing information on such matters with the Go v ernors of the States. SEC.352 . AN N U A LR E PO R T ON PREPOS I TIONE DM ATERIEL AND E Q UIP - MENT. (a) ANNUAL REPORT REQUIRED.—Chapter 131 of title 10, United States Code, is amended by adding at the end the following new section

‘ §2 22 9a.An n u a lrepo r t on prepo si tione dm ateriel and e q uip - ment ‘ ‘(a) ANNUAL REPORT REQUIRED.—Not later than the date of the submission of the President ’ s budget request for a fiscal year under section 1105 of title 31, the Secretary of Defense shall submit to the congressional defense committees a report on the status of the materiel in the prepositioned stocks as of the end of the fiscal year preceding the fiscal year during which the report is submitted. Each report shall be unclassified and may contain a classified anne x . Each report shall include the following informa- tion: ‘‘(1) The level of fill for major end items of equipment and spare parts in each prepositioned set as of the end of the fiscal year covered by the report. ‘‘(2) The material condition of equipment in the prepositioned stocks as of the end of such fiscal year, grouped by category or major end item. ‘‘(3) A list of major end items of equipment drawn from the prepositioned stocks during such fiscal year and a descrip- tion of how that equipment was used and whether it was returned to the stocks after being used. ‘‘(4) A timeline for completely reconstituting any shortfall in the prepositioned stocks. ‘‘(5) An estimate of the amount of funds required to com- pletely reconstitute any shortfall in the prepositioned stocks 10USC482note.
