‘‘(ii) is organized thro u gh school , community, and health p ro v ider relationships; ‘‘(iii) is administered by a sponsoring facility; ‘‘(iv) provides through health professionals primary health services to children in accordance w ith State and local law, including laws relating to licensure and certification; and ‘‘(v) satisfies such other re q uirements as a State may establish for the operation of such a clinic. ‘‘( B )S P ONSOR I NG F ACILIT Y .— F or purposes of subpara- graph (A)(iii), the term ‘sponsoring facility’ includes any of the following

‘‘(i) A hospital. ‘‘(ii) A public health department. ‘‘(iii) A community health center. ‘‘(iv) A nonprofit health care agency. ‘‘(v) A school or school system. ‘‘(vi) A program administered by the Indian H ealth Service or the Bureau of Indian Affairs or operated by an Indian tribe or a tribal organization.’’. SEC.506 . M E DI C A IDA N DC H I P PA Y MEN T AND ACCESS C O MMISSION. (a) IN G ENERAL.—Title X IX( 42U .S. C . 13 9 6 et seq.) is amended by inserting before section 19 0 1 the following new section: ‘‘ M EDICAID AND CHIP PAYMENT AND ACCESS COMMISSION ‘‘SEC. 1900. (a) E STABLISHMENT.—There is hereby established the M edicaid and CHI P Payment and Access Commission (in this section referred to as ‘MACPAC’). ‘‘(b) DU TIES.— ‘‘(1) R E V IE W OF ACCESS POLICIES AND ANNUAL REPORTS.— MACPAC shall— ‘‘(A) review policies of the Medicaid program estab- lished under this title (in this section referred to as ‘Med- icaid’) and the State Children’s Health Insurance Program established under title XXI (in this section referred to as ‘CHIP’) affecting children’s access to covered items and services, including topics described in paragraph (2); ‘‘(B) ma k e recommendations to Congress concerning such access policies; ‘‘(C) by not later than March 1 of each year (beginning with 2010), submit a report to Congress containing the results of such reviews and MACPAC’s recommendations concerning such policies; and ‘‘(D) by not later than J une 1 of each year (beginning with 2010), submit a report to Congress containing an e x amination of issues affecting Medicaid and CHIP, including the implications of changes in health care delivery in the United States and in the market for health care services on such programs. 42USC1396.
