N otwithstanding an y other provision of this A ct , none of the funds appropriated or otherwise m ade available by this Act may be used to pay award or incentive fees for contractor performance that has been judged to be below satisfactory perform- ance or performance that does not meet the basic re q uirements of a contract. SEC. 5 7 0. None of the funds appropriated or otherwise made available by this Act may be used by the D epartment of H omeland Security to enter into any federal contract unless such contract is entered into in accordance with the requirements of the F ederal P roperty and Administrative Services Act of 1 949 (41 U .S. C . 25 3 ) or Chapter 137 of title 10, United States Code, and the Federal Acquisition R egulation, unless such contract is otherwise authori z ed by statute to be entered into without regard to the above referenced statutes. SEC. 571. (a) Funds made available by this Act solely for data center migration may be transferred by the Secretary between appropriations for the same purpose, notwithstanding section 503 of this Act. (b) No transfer described in (a) shall occur until 15 days after the Committees on Appropriations of the Senate and the House and Representatives are notified of such transfer. SEC. 572. Specific projects contained in the report of the Com- mittee on Appropriations of the House of Representatives accom- panying this Act (H. Rept. 111 – 157) that are considered congres- sional earmar k s for purposes of clause 9 of rule X X I of the Rules of the House of Representatives, when intended to be awarded to a for-profit entity, shall be awarded under a full and open competition. SEC. 573. From unobligated balances for fiscal year 2009 made available for Federal E mergency M anagement Agency ‘‘ T rucking Industry Security G rants’’, $ 5,572,000 are rescinded. SEC. 574. From the unobligated balances of prior year appro- priations made available for ‘‘Analysis and O perations’’, $2,35 8 ,000 are rescinded. SEC. 575. From the unobligated balances of prior year appro- priations made available for National Protection and Programs Directorate ‘‘Infrastructure Protection and Information Security’’, $8,000,000 are rescinded. SEC. 576. From the unobligated balances of prior year appro- priations made available for Science and Technology ‘‘Research, Development, Acquisition, and Operations’’, $6,944,148 are rescinded. SEC. 577. From the unobligated balances of prior year appro- priations made available for Domestic Nuclear Detection Office ‘‘Research, Development, and Operations’’, $8,000,000 are rescinded. SEC. 578. From the unobligated balances of prior year appro- priations made available for Transportation Security Administration ‘‘Research and Development’’, $4,000,000 are rescinded. SEC. 579. From the unobligated balances of prior year appro- priations made available for Coast Guard ‘‘Acquisition, Construc- tion, and Improvements’’, $800,000 are rescinded
