123STA T . 233 7PUBLIC LA W 111 –84—O CT. 28 , 2 0 0 9‘ ‘ (i i ) i nsup p ort o f fost e rin ga n d sustaining a c ooperati v e re l ations h ip w ith another nation . ‘‘( b ) PROHIB I T IO N O FM I L IT A R Y M US I C IANS A CC EP TIN G A D DI - TIONAL R E M UNERATION FOR O FFICIAL PERFORMANCES. — A m ilitar y musical unit , and a member of the armed forces who is a member of such a unit performing in an official capacity, may not receive remuneration for an official performance, other than applicable military pay and allowances. ‘‘(c) RECORDINGS.—( 1 ) W hen authori z ed under regulations pre- scribed by the S ecretary of D efense for purposes of this section, a military musical unit may produce recordings for distribution to the public, at a cost not to e x ceed expenses of production and distribution. ‘‘( 2 ) Amounts received in payment for a recording distributed to the public under this subsection shall be credited to the appro- priation or account providing the funds for the production of the recording. Any amount so credited shall be merged with amounts in the appropriation or account to which credited, and shall be available for the same purposes, and sub j ect to the same conditions and limitations, as amounts in such appropriation or account. ‘‘(d) PERFORMANCES AT F OREIGN L OCATIONS.—Subsection (a) does not apply to a performance outside the U nited States, its commonwealths, or its possessions. ‘‘(e) MILITARY MUSICAL UNIT DEFINED.— I n this section, the term ‘military musical unit ’ means a band, ensemble, chorus, or similar musical unit of the armed forces.’’. (b) C LERICAL AMENDMENT.— T he item relating to such section in the table of sections at the beginning of chapter 49 of such title is amended to read as follows

(a) G RANTS AUTHORI Z ED.—Chapter 6 4 7 of title 1 0 , United States Code, is amended by inserting after section 7 5 41a the fol- lowing new section: ‘ ‘ §7541b.Authori t y to makeg ra n t sf or p urposes of N a v a lS ea C a d et Corps ‘‘Subject to the availability of funds for this purpose, the Sec- retary of the N avy may ma k e grants to support the purposes of Naval Sea Cadet Corps, a federally chartered corporation under chapter 1541 of title 3 6.’’. (b) CLERICAL AMENDMENT.—The table of sections at the begin- ning of chapter 647 of such title is amended by inserting after the item relating to section 7541a the following new item: ‘‘7 5 4 1b . A uthority to ma k e g rants for purposes of N aval S ea C adet Corps.’’. SEC. 59 3 . M OD I FICATION OF MATC H ING FUND RE Q UIREMENTS UNDER NATIONAL GUARD YOUTH CHALLENGE PROGRAM. (a) AUTHORITY TO INCREASE DOD SHARE OF PROGRAM.—Section 509(d)(1) of title 32, United States Code, is amended by striking ‘‘60 percent of the costs’’ and inserting ‘‘75 percent of the costs’’. (b) E FFECTI V E DATE.—The amendment made by subsection (a) shall take effect on October 1, 2009, and shall apply with respect to fiscal years beginning on or after that date. 32USC509note.
