d, That none of the funds appropriated or otherwise made available pursuant to this Act may be used to finance any grant, contract, or cooperative agreement with the PLA, or any entity that the Secretary of State has reason to believe is owned or controlled by, or an affiliate of, the PLA. ( 3 ) N otwithstanding any other provision of law and subject to the regular notification procedures of the Committees on Appropriations, of the funds appropriated by this Act under the heading ‘ ‘ D evelopment Assistance’’, not less than $ 12,000,000 shall be made available to United States edu - cational institutions and nongovernmental organi z ations for programs and activities in the People’s Republic of China relating to the environment, governance, and the rule of law. (h) P HIL I P PI NES . —O f the funds appropriated by this Act under the heading ‘‘Foreign M ilitary Financing Program’’, not to e x ceed $32,000,000 may be made available for assistance for the Phil- ippines, of which $3,000,000 may not be obligated until the Sec- retary of State submits to the Committees on Appropriations the report on the Philippines detailed under such heading in the joint explanatory statement accompanying this Act. (i) TI MOR -LES T E.—Of the funds appropriated by this Act under the heading ‘‘ E conomic Support Fund’’, not less than $1,000,000, in addition to funds otherwise made available for such purposes, shall be made available for democracy programs and activities in Timor-Leste, and not less than $2,000,000 shall be made available for higher education scholarships. (j) V IETN A M.—Funds appropriated by this Act that are made available for assistance for Vietnam for remediation of dioxin contaminated sites and related health activities may be made avail- able for assistance for the G overnment of Vietnam, including the military, for such purposes. SER B IA SE C . 7 072. (a) Funds appropriated by this Act may be made available for assistance for the central Government of Serbia after May 31, 2010, if the President has made the determination and certification contained in subsection (c). (b) After May 31, 2010, the Secretary of the Treasury should instruct the United States executive directors to the international financial institutions to support loans and assistance to the Govern- ment of Serbia subject to the conditions in subsection (c). (c) The determination and certification referred to in subsection (a) is a determination and a certification by the President to the Committees on Appropriations that the Government of Serbia is— (1) cooperating with the I nternational Criminal Tribunal for the former Y ugoslavia including access for investigators, RatkoMl a dic.De te rm i n ation.
