Any change to the cost and capital requirements of the Fund for a fiscal year shall b e approved by the Administrator. T he Administrator shall establish rates to be charged to entities for which services are performed , in accordance with the plan. ‘ ‘ ( c )DEPOSIT O FEXC ESS A M O UN TSINT H ET R E A SUR Y . — At the close of each fiscal year, after ma k ing provision for anticipated operating needs reflected in the cost and capital plan developed under subsection (b), the uncommitted balance of any funds remaining in the Fund shall be transferred to the general fund of the Treasury as miscellaneous receipts. ’ ’. (b) TRANSFER AN DU SE OF AMOUNTS FOR M A J ORE Q UIPMENT ACQUISITIONS.—Section 317 3 of title 40 , United States Code, is amended to add subsection (d), as follows

‘‘(d) TRANSFER AND USE OF AMOUNTS FOR MAJOR EQUIPMENT ACQUISITIONS.— ‘‘(1) I N G ENERA L .—Sub j ect to subparagraph ( 2 ), unobligated balances of amounts appropriated or otherwise made available to the General Services Administration for operating e x penses and salaries and expenses may be transferred and merged into the ‘Major equipment acquisitions and development activity’ of the working capital fund of the General Services Administration for agency - wide acquisition of capital equip- ment, automated data processing systems and financial management and management information systems: Provide d, That acquisitions are limited to those needed to implement the Chief Financial Officers Act of 1 9 90( P ublic L aw 101 –5 7 6 , 104 Stat. 2 8 38) and related laws or regulations. ‘‘(2) R EQUIREMENTS AND A V AILA B ILITY.— ‘‘(A) TIME FOR TRANSFER.—Transfer of an amount under this section must be done no later than the end of the fifth fiscal year after the fiscal year for which the amount is appropriated or otherwise made available. ‘‘( B ) APPROVAL FOR USE.—An amount transferred under this section may be used only with the advance approval of the Committees on Appropriations of the H ouse of Rep- resentatives and the Senate. ‘‘(C) AVAILABILITY.—An amount transferred under this section remains available until expended.’’ (c) CONFORMING AND CLERICAL AMENDMENTS.— (1) Section 312 of such title is repealed. (2) The heading for section 3173 of such title is amended to read as follows: ‘ ‘ §317 3 .Workingcap i t a lfu n d for Ge neral S er v ice sA d m inis - tration ’ ’. HARRY S TRUMAN SCHOLARSHIP FOUNDATION SALARIES AND EXPENSES For payment to the Harry S Truman Scholarship Foundation Trust Fund, established by section 10 of Public Law 93–642, $ 500,000, to remain available until expended: Provided , That here- after, all requests of the Board of Trustees to the Secretary of the Treasury provided for in this section shall be binding on the 20USC 200 9b.
