(a) Funds appropriated by titles III and I V of this Act that are made available for bilateral assistance for child survival activities or disease programs including activities relating to research on, and the prevention, treatment and control of, HIV / AIDS may be made available notwithstanding any other provision of law except for the provisions under the heading ‘‘ G lobal Health and Child Survival’’ and the United States Leadership Against HIV/AIDS, Tuberculosis, and M alaria Act of 2003 (117 Stat. 711
22 U.S.C. 7601 et se q .), as amended: Provided, That of the funds appropriated under title III of this Act, not less than $54 5,000,000 should be made available for family planning/reproductive health. (b) Notwithstanding any other provision of this Act, 10 percent of the funds that are appropriated by this Act for a contribution to support the Global Fund to Fight AIDS, Tuberculosis and Malaria (the ‘‘Global Fund’’) shall be withheld from obligation to the Global Fund until the Secretary of State reports to the Committees on Appropriations that the Global Fund— (1) is releasing incremental disbursements only if grantees demonstrate progress against clearly defined performance indicators; and (2) is implementing a reporting system that brea k s down grantee budget allocations by programmatic activity. D EVELO PM ENT GRANTS PROGRAM SEC. 7061. Of the funds appropriated by this Act under the heading ‘‘Development Assistance’’, not less than $40,000,000 shall be made available for the Development Grants P rogram established pursuant to section 674 of the Department of State, Foreign Oper- ations, and R elated Programs Appropriations Act, 2008 (division J of Public Law 110 – 161): Provided, That funds made available under this section are in addition to other funds available for such purposes including funds designated by this Act by section 7065. W OMEN IN DEVELOPMENT SEC. 7062. (a) Programs funded under title III of this Act should include, where appropriate, gender considerations in the planning, assessment, implementation, monitoring and evaluation of such programs. (b) Funds made available under title III of this Act should be made available to support programs to enhance economic opportunities for poor women in developing countries, including increasing the number and capacity of women-owned enterprises, improving property rights for women, increasing access to financial Reports.Ex p i r a tio nd ate.
