OPERATION AND MAINTENANCE, MARINE CORPS For an additional amount for ‘‘Operation and Maintenance, Marine Corps’’, $829,326,000, of which $30,700,000 shall be avail- able to restore amounts transferred from this account to ‘‘Overseas Humanitarian, Disaster, and Civic Aid’’ for emergency relief activi- ties related to Haiti following the earthquake of January 12, 2010, and for other disaster-response activities relating to the earthquake. OPERATION AND MAINTENANCE, AIR FORCE For an additional amount for ‘‘Operation and Maintenance, Air Force’’, $3,835,095,000, of which $218,400,000 shall be available to restore amounts transferred from this account to ‘‘Overseas Humanitarian, Disaster, and Civic Aid’’ for emergency relief activi- ties related to Haiti following the earthquake of January 12, 2010, and for other disaster-response activities relating to the earthquake. OPERATION AND MAINTENANCE, DEFENSE-WIDE (INCLUDING TRANSFER OF FUNDS) For an additional amount for ‘‘Operation and Maintenance, Defense-Wide’’, $1,236,727,000: Provided, That up to $50,000,000, to remain available until expended, shall be available for transfer to the Port of Guam Improvement Enterprise Fund established by section 3512 of the Duncan Hunter National Defense Authoriza- tion Act for Fiscal Year 2009 (Public Law 110–417): Provided fur- ther, That funds transferred under the previous proviso shall be merged with and available for obligation for the same time period and for the same purposes as the appropriation to which trans- ferred: Provided further, That these funds may be transferred by the Secretary of Defense only if he determines such amounts are required to improve facilities, relieve port congestion, and provide greater access to port facilities: Provided further, That any amounts transferred pursuant to the previous three provisos shall be avail- able to the Secretary of Transportation, acting through the Adminis- trator of the Maritime Administration, to carry out under the Port of Guam Improvement Enterprise Program planning, design, and construction of projects for the Port of Guam to improve facilities, relieve port congestion, and provide greater access to port facilities: Provided further, That the transfer authority in this section is in addition to any other transfer authority available to the Depart- ment of Defense: Provided further, That the Secretary shall, not Deadline.
