Revised Statutes so far as the same affects certain drafts upon him now held by the Masonic Bank of Pittsburgh, Pennsylvania. Carey, paymaster United States Army, did issue his checks , upon the United States assistant treasurer at New York one for eighty- eight dollars and three cents and one for eighty-eight dollars and fifty- three cents, payable to the order of J efferson Mcllwaine; and Whereas, the said Jefferson Mcllwaine did, on the twenty-ninth day of September, eighteen hundred and seventysix, execute his power of attorney to Hugh Mcllwaine, empowering him, the said Hugh Mcllwaine, to indorse any checks or drafts issued by the government made payable to the order of him, the said J efterson Mcllwaine, and Whereas, the Masonic Bank of Pittsburgh did, upon an indorsement of the said checks by the said Hugh Mcllwainc, purchase and pay for the same; and Whereas the Treasury of the United States refuses to redeem said checks because the power of attorney to indorse the same was executed before the checks were issued, instead of after their said "issue, as required by law; and .
