That said Ohio Valle Electric Railwa Com an shall subuppme phmS'€tc` mit in triplicate to the Secrelzfary of War, for yhis exliimhiation and approval, a design and drawings of the bridge, piers, approaches, and accessory works, and a map of the location, giving, for the space of at least one mile above and one mile below the proposed site, the topography of the banks of the river and the shore lines at high and low water, the direction and strength of the currents at low water and at high water, the location of all bridges, locks and dams, coal ti ples, cribs, and all other structures projectin into the river at band);-full stage, in the vicinity, and such other information as the Secretary of War may require for a full and satisfactory understanding of the subject; and until such plan and location of the bridge and accessory works are approved by the Secretary of War the bridge shall not be commenced or built; and should any change be made in the plan of said bridge during the progress of construction, or after completion, such change shall be subject to the approval of the Secretary of War. That said bridge herein authorized to be constructed shall be so kept and managed at all times as to aiford lproper means and ways for the passage of vessels, barges, or rafts, bot by day and by night; Lights- and there shall be displayed on said bridge by the owners thereof, from sunset to sunrise, such lights or other signals as the Light-House Board may prescribe; and suci indications of the sta e of water and the headroom under the bridge as the Secretary of %’ar may direct Ch¤¤€€¤· shall be displayed by the owners thereof; and such changes shall be made from time to time in the structure of said bridge as the Secretary of War may direct, at the expense of the said company, in order the more eifectually to (preserve the free navigation of said river. mfga‘;§,lI§,j;{*;l0$,g;¤°·. Sec. 6. That said bridge shall be a lawful structure and shall be ` recognized and known as a post route, upon which also no higher charge shall be made for the transportation over the same of the mails, the troops, and the munitions of war of the United States than the rate per mile paid for the transportation of said mails, troops, and munitions over the railroads an plublic highways leading to said bridge; and the United States shall ave the right of way for postaltelegraph and telephone purposes over said bridge. migiht of mil‘·*’¤YS Sec. 7. That all railway companies desiring the use of said bridge ` shall have and be entitled to equal rights and privileges relative to the passage of railway trains or cars over the same and over the approaches thereto, upon payment of a reasonable compensation for such use; and in case the parties interested shall fail to agree upon the sum or sums to be paid, and upon the rules and conditions to which each shall conform in using said bridge, all matters at issue between them shall, upon the application of either party, be determined by the Secretary o War upon a hearing of the a legations and proofs of the parties. dL§Ijg8*;*:}§S,g{1‘ggg;l- Sec. 8. That during the original construction of said bri ge, or in sw. ’ carrying out any authorized changes or repairs of said bridge, a navigable channel sufficient to accommodate the commerce of the river shall e preserved at all times at the site of said bridge, and the waterway of the river shall not be obstructed to a greatercextent than is absolutely necessary, and such lights and buoys shall be kept on all cofferdams, piles, and other structures as may be necessary for the security of navigation; and that any temporary obstruction or closin of any channel in customary· use shall not be commenced until after due notice to navigation; and all coiferdams, piles, and other structures used in the construction or relpair of said bridge shall be removed within a reasonable time after the completion or repair of said bridge. ,,u%°§§,’,§,°,,€,§§;‘(,‘§,{“"“‘ Sec. 9. That this Act shall be null and void if actual construction of the bridge herein authorized be not commenced within one year and completed within three years from the date hereof.
