States of America in Congress assembled, at the consent of Con- dg1¤g¤W· 111435} mw gress is hereby granted to the city of Warsaw, being a city incor- sm ' porated and organized under the laws of the State of Missouri, its successors or assigns, to construct, erect, and maintain a dam across the Osa e River, in Benton County, in the State of Missouri, at said city of §’Varsaw, and all work necessarily incident thereto: Provided, P··¤vi·¤<>s- That the said city of Vllarsaw, its successors or assigns, shall make Cheeses in consuch change and modification in the works as the Secretary of Vllar S°m°n°°' may from time to time deem necessary in the interest of navigation, at its own cost and ex ense: Provided further, That in case any litiga- Lmgmon. tion 8.1'lSBS from the building of said dam, the maintaining of the same, or from the obstruction of the said river by said dam or appurtenant works, cases may be tried in the proper courts as now provided for téhat purpose in the State of Missouri and the courts of the United tates. That the right to amend, alter, or repeal this Act is hereb M¤¤¤dr¤¤¤¢~ expressly reserved: And provided farther, That suitable iishways shall gigmbe copstructed and maintained at said dam by said city, its successors wm` and assigns, as may be required from time to time by the United States Fish Commissioner.
