That neither the United States nor the District of Columbia, E"°"“°“· -nor any omcer, agent, or servant thereof, shall be at any expense by reason of the deliver of any body or bodies aforesaid, except suc as may be properly chargeable on account of bodies delivered to the medical schools of the Army and Nav , the medical examining boards of the Army, the Navy, and the Miirine-Hospital Service, and the board of medical su rvisors of the District of Columbia; but all expenses of such deliifery and distribution, except as hereinbefore specified, and of said anatomical board, shall be paid by the schools receiving such bodies, in such manner as may be specified by said board and by such school in proplortion to the number of bodies which it has received; and no school w ich has failed or refused to my its just proportion of such expense as determined by said board s l be allowed to receive any body or bodies, or parts thereof, while the amount so due remains unpaid. _ Sec. 8. That any person having any duty enjoined upon him by the df,';]"" *° P""’°“" provisions of this Act who willfully ne lects, refuses, or fails to perform the same, shall, upon conviction giereof, be punished by a tine P°"“l“" of not more than one hundred dollars or by imprisonment in the work- ' house of the District of Columbia for not more than one year. Sec. 9. That all prosecutions under this Act shall be in the police P’°“°“"°“ court of the District of Columbia, on information brought in the name of said District on its behalf. Sec. 10. [Public, N0_ gg_] Be é thenacted by the Senate and House ofRripresentati/res of the Dizited States of America in Cwgress assembled, That the Secretary of \Var mfggcrfhu K°*¤’¤Y be, and he is hereby, authorized and directed to mark the site of the _Monu¤ieut no mark Fort Phil Kearny massacre, that occurred on the twenty—iirst of Decem- mm °f‘ ber, eighteen hundred and sixty-six, by erecting on said site a monument of rough masonry and an historical tablet: Provided, That the gimsite of the proposed monument, of not less than one-fourth of an acre ` in area, situated upon the most sightly portion of Massacre Hill, shall be donated to the Tnited States. Sec. 2. That for the purpose of carrying this Act into effect the sum ·*PP*°P’*·**°¤· of five hundred dollars, or so much thereof as may be necessary, is hereby appropriated, out of any public moneys in the Treasury of the United States not otherwise appropriated, to be expended under direction of the Secretary of War.
