per cent. fund, arising from the net proceeds of the sales of public lands, within the state of Mississippi, may be appropriated by the legislature thereof, to the making of public roads and canals, and to the improvement of the navigation of rivers and bays, within said state.

Chap. XVI.—An Act making appropriations for the Indian department, for the year one thousand eight hundred and twenty-six.
Specific appropriations for the Indian department.Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the following sums be, and the same are hereby, appropriated, to wit:
Superintendent of Indian affairs, &c.For the pay of the superintendent of Indian affairs at St. Louis, and the several Indian agents, as established by law, twenty-nine thousand five hundred dollars.
Sub-agents, &c.For the pay of sub-agents, as established by law, thirteen thousand five hundred dollars.
Presents to Indians, &c.For presents to Indians, as authorized by act of one thousand eight hundred and two, fifteen thousand dollars.
Contingent expenses.For the contingent expenses, ninety-five thousand dollars.
Money to be paid from the treasury.

Proviso.Sec. 2. And be it further enacted, That the several sums hereby appropriated shall be paid out of any money in the treasury not otherwise appropriated: Provided, however, That no money appropriated by this act shall be paid to any person, for his compensation, who is in arrears to the United States, until such person shall have accounted for and paid into the treasury all sums for which he may be liable: Provided also, That nothing in this section contained shall be construed to extend to balances arising solely from the depreciation of treasury notes, received by such person to be expended in the public service; but in all cases where the pay or salary of any person is withheld in pursuance of this act, it shall be the duty of the accounting officer, if demanded by the party, his agent or attorney, to report forthwith to the agent of the Treasury Department, the balance due, and it shall be the duty of the said agent, within sixty days thereafter, to order suit to be commenced against such delinquent and his sureties.

Chap. XVII.—An Act making appropriations for the military service of the United States, for the year one thousand eight hundred and twenty-six.
Specific appropriation for the year 1826.Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the following sums be, and the same are hereby, respectively appropriated, for the military service of the United States, for the year one thousand eight hundred and twenty-six, to wit:
Army, &c. and military academy.For pay of the army, and subsistence of officers, including the military academy, nine hundred and ninety-four thousand four hundred and seven dollars and seventy-five cents.
Subsistence.For subsistence, two hundred and eighty-nine thousand one hundred dollars.
Forage for officers.For forage for officers, thirty-five thousand five hundred and twenty dollars.
Recruiting service.For the recruiting service, in addition to an unexpended balance, on the thirty first of December, one thousand eight hundred and twenty-five, of six thousand seven hundred and sixty-nine dollars, twelve thousand one hundred and forty-five dollars.
