Be it enacted by the Senate and HOWle of Representatives of the United States of America in Oongress a8semhled, That the United States Employees' Com{>ensation Commission is hereby authorized to consider and determme the claim of Captain J. O . Faria, on account of injuries sustained by him while employed by the United States Shippln~ Board as master of the steamship Commack, in the year 1925, m the same manner and to the same extent as if said Captain J. O . Faria had made application for the benefits of the Act entitled "An Act to provide compensation for employees of the United States suffering injuries while in the performance of their duties, and for other purposes ", approved September 7, 1916, as amended, within the one-year period required by sections 17 and 20 thereof: Provided, That no benefits shall accrue prior to the a pproval of this Act. James, out of any money in the Treasury not otherwise appropriated, the sum of $7,000, the amount of a fine paid by Robert B. James in pursuance of a judgment entered upon a plea nolo contendere under certain provisions of the so-called Lever Act previous to the time that the Supreme Court of the United States held such provisions void, the said plea and said payment being made under a stipulation as follows: "In consideration that the Attorney General and this court shall accept the plea nolo contendere which I hereby tender to the above-entitled indictment I do hereby waive any and all fines which the court may see fit to impose upon me upon such plea", except in the event that the so-called Lever Act under which said indictment is found shall be declared unconstitutional by the Supreme Court of the United States and that no prosecution could be sus- tained upon the facts stated in said indictment: Provided, That no Pr L · o/'!t'Ot'l tt~~ fh . d'h'A' f Inu.aonona~- part 0 t e amount approprIate III t IS ct In excess 0 10 per ney's, etc., fees. centum thereof shall be paid or delivered to or received by anv agent or agents, attorney or attorneys, on account of services rendered in connection with said claim. It shall be unlawful for any agent or agents, attorney or attorneys, to exact, collect, withhold, or receive any sum of the amount appropriated in this Act in excess of 10 per centum thereof on account of services rendered in connection with said claim, any contract to the contrary notwithstanding.
