The Secretary of the Treasury shall enforce the provisions Enfo rcement . of this Act and of sections 238, 239, and 240 of the Criminal Code (U . S . C ., 1934 ed ., title 18, sees. 388-390), as herein amended . The Secretary of the Treasury is authorized to confer and impose Deleg ation of a uthor- upon the Commissioner of Internal Revenue and any of his assist- ing'Act' forad mini star- ants, agents, or employees, and upon any other officer, employee, or agent of the Treasury Department, any of the rights, privileges, powers, duties, and protection conferred or imposed upon the Secre- tary of the Treasury, or any officer or employee of the Treasury Department, by this Act, or by any law now or hereafter in force relating to the taxation, importation, exportation, transportation, manufacture, possession, or use of, or traffic in, distilled spirits, wine, fermented liquors, or denatured alcohol . Regulations to carry out the provisions of this Act shall be pre- prRegulations to be scribed by the Commissioner of Internal Revenue with the approval of the Secretary of the Treasury . SEC . 6 . Section 238 of the Criminal Code (U. S. C., 1934 ed., Crim inal C ode a mendm ents . title 18, sec . 388), is amended to read as follows :

C .,p.733 , "Any officer, agent, or employee of any railroad company, express tootherthan shipments consignee; company, or other common carrier, who shall knowingly deliver or exception . cause to be delivered to any person other than the person to whom it has been consigned, unless upon the written order in each instance of the bona fide consignee, or to any fictitious person, or to any person u nder a fictitio us name , any sp irituou s, vinou s, malt ed, or other fe rmented liquor or any compound contai ning any spirit uous, vinous , malted , or ot her ferm ented l iquor fi t for u se for beverage purposes, which has been shipped from one State, Territory, or District of the United States, or place noncontiguous to but subject to the jurisdiction thereof, into any other State, Territory, or District of the United States, or place noncontiguous to but subject to the jurisdic tion th ereof, o r from any fore ign cou ntry int o any State, Territory, or District of the United States, or place noncontiguous to but subject to the jurisdiction thereof, shall be fined not more Penalty' than $1,000 or imprisoned not more than one year, or both ." SEC. 7. Section 239 of the Criminal Code (U . S. C., 1934 ed., title u.s. C.,p.753. 18, sec . 389) is amended to read as follows : "Any railroad company, express company, or other common car- in carrier, etc ., collect- " purchase price, or tier, or any other person who, in connection with the transportation acting as agent of buyer of any spirituous, vinous, malted, or other fermented liquor, or any o reelC r' compound containing any spirituous, vinous, malted, or other fer- mented liquor fit for use for beverage purposes, from one State, Territory, or District of the United States, or place noncontiguous to but subject to the jurisdiction thereof, into any other State, Ter- ritory, or District of the United States, or place noncontiguous to but subject to the jurisdiction thereof, which prohibits the delivery or sale therein of such liquor, or from any foreign country into any su ch State , Terri tory, or Distri ct of th e Unite d States , or place nonco ntigu ous to bu t su bject to the j uris dicti on t hereo f, s hall coll ect the purchase price or any part thereof, before, on, or after delivery, from the consignee, or from any other person, or shall in any man- ner act as the agent of the buyer or seller of any such liquor, for the purpose of buying or selling or completing the sale thereof, saving only in the actual transportation and delivery of the same, shall Penalty . be fined not more than $5,000 or imprisoned not more than one year, or both ."
