Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the following sums are appropriated, out of any money in the Treasury not other- wise ap propria ted, fo r the D epartme nt of A gricult ure and for th e Farm Credit Administr ation for the fiscal year endi ng June 30, 1938, namely TITLE I-DEPARTMENT OF AGRICULTURE OFFICE OF THE SECRETARY

SALARI ES For the Secretary of Agriculture, Under Secretary of Agriculture, Assistant Secretary, and for other personal services in the District of Columbia, and elsewhere, $452,700 : Pro vided, That in expending appropriations or portions of appropriations contained in this Act for the payment of personal services in the District of Columbia in accordance with the C lassificat ion Act of 1923, as amended, w ith the exception of the Assi stant Secr etary, the average of the sala ries of the total number of persons under any grade in any bureau, office, or other appropriation unit shall not at any time exceed the average of the compens ation r ates sp ecified for th e grade by suc h Act a s amended and in grades in which only one position is allocated the salary of such position shall not exceed the average of the compensa- tion rates for the gr ade, excep t that in unusually meritoriou s cases of one position in a grade advances may be made to rates higher than the av erage of t he compens ation rate s of the g rade but n ot more often than once in any fiscal year and then only to the next hi her rate : Provided further, That this restrictio n shall no t apply (1 ) to grades 1, 2, 3, and 4 of the clerical-mechanical service, or (2) to require the re duction in sal ary of any per son who se comp ensatio n was fixed as of July 1, 1924, in accordance with the rules of section 6 of such Act, (3) to require the reduction in salary of any person who is tran sferred fr om one pos ition to a nother pos ition in t he same or differen t grade, i n the same or differ ent bureau, office, or other appropriation unit, (4) to prevent the payment of a salary under any grade at a rate higher than the maximum rate of the grade when such higher rate is permitted by the Classification Act of 1923, as amended, and is specifically authorized by other law, or (5) to reduce the compensation of any person in a grade in which only one position is allocated : Provided further, That the Secretary of Agriculture is authorized to contract for stenographic reporting services, a nd the app ropriation s made in this Act s hall be av ailable for such purposes : Provided further, That the Secretary of Agricul- ture is authorized to expend from appropriations available for the purchase of lands not to exceed $1 for each option to purchase any particular tract or tracts of land : Provided further, That not to exceed $40,000 of the appropriations available for salaries and expenses of officers and employees of the Department of Agriculture permanently stationed in foreign countries may be used for payment of allowances for living quarters, including heat, fuel, and light, as authorized by the Act approved June 26, 1930 (U . S . C., title 5, sec . 118a) : Provided further, That with th e appr oval of the Se cre- tary of Agriculture employees of the Department of Agriculture 395 Department of Agri- culture and Farm Credit Administra- tion appropriations, fiscal year 1938 .
