AN ACT III . R . 70171 To amend section 4450 of the Revised Statutes of the United States, as amended [Public, No. 225]

by the Act of May 27, 1936 (49 Stat. 1380, 1383 ; U . S. C ., 1934 edition, title 46, sec. 239). Be it enacted by the Senate and House of Representatives of the United States o America in Congress assembled, That section 4450 of the Revised Statutes of the United States, as amended by the Act of May 27, 1936 (49 Stat. 1380, 1383 ; U . S. C ., 1934 edition, title 46, sec . 239), is amended by inserting in the third sentence of paragraph (g) of said section the words "suspended or", after the word "is" and before the word "revoked", so that the said paragraph (g) of said section, when amended, shall read as follows "(g) In any investigation of acts of incompetency or misconduct or of any act in violation of the provisions of this title, or of any of the regula tions issued there under, commit ted by any l icense d offi cer or any holder of a certificate of service, the person whose conduct is under investigation shall be given reasonable notice of the time, place, and subject of such investigation and an opportunity to be heard in his own defense . The whole record of the testimony rece ived b y the board conduc ting s uch inv estiga tion a nd the findi ngs and recommendations of such board shall be forwarded to the Director of the Bureau of Marine Inspection and Navigation, and if that officer shall find that such licensed officer or holder of certificate of se rvice is incompete nt or has been gui lty of m isbehavio r, neglig ence, or u nskill fulnes s, or has en danger ed life , or h as wil lfully viola ted any of the provisions of this title or any of the regulations issued there under, he shall, i n a writt en order reciting said fin dings, su spend or revoke the license or certificate of service of such officer or holder of such certificate . The person whose license or certificate of service is suspended or revoked may, within thirty days, appeal from the order of the said Director to the Secretary of Commerce . On such appeal the appellant shall be allowed to be represented by counsel . The Secretary of Commerce may alter or modify any finding of the boa rd wh ich condu cted the inves tigat ion or of the Direc tor of th e Bureau of Marine Inspection and Navigation, but the decision of the Secretary of Commerce shall be based solely on the testimony received by the said board and shall recite the findings of fact on which it is based ." Be it enacted by the Senate and House o f Representatives o f the United States of America in Congress assembled, That for the pur- pos e of f urnish ing or repla cing a uxilia ry vess els ur gently neces sary for the proper maintenance and operation of the Navy, the Presi- dent of the United States is hereby authorized to undertake the cons tructi on of about thirty -six t housand and f ifty t ons (l ight d is- placement tonnage) of such auxiliary vessels as follows at a total cost for all vessels of not more than $50,000,000 : (a) One seaplane tender of about eight thousand three hundred tons ; b) One destroyer tender of about nine thousand tons ; (c) One mine sweeper of about six hundred tons ;
