75TH CONGRESS, 1sT SESSION-CH. 690,---AUGUST 17, 1937 or dealer shall, at all times during the business hours of the day, be subject to inspection by the assessor and the collector of taxes of the District of Columbia, or by their duly authorized agents, or by any other agent duly authorized by the - Commissioners to make such inspection ." SEC . 6. Section 8 of said Act is hereby amended to read as follows "SEC . 8. That it shall be unlawful for any person to accept or receive from any importer or distributor, except in cases of retail sales, any motor-vehicle fuel unless the statement provided for in section 5 of this Act appears upon the invoice for the fuel . If any such motor-vehicle fuel is received and accepted by any person upon the invoice of which said statement does not appear, such person shall pay to the collector of taxes the tax herein imposed ." SEC. 7. Section 11 of said Act is hereby amended by striking out subse ction (b) th ereof and a mendin g subs ectio n (a) to read as follows "SEC. 11 . That any person violating any provision of sections 3 to 6, inclusive, or section 8, or refusing or obstructing inspection under section 7, or falsely making any statement or report required by this Act, shall be deemed guilty of a misdemeanor and upon conviction thereof s hall be punish ed by a fine of not less t han $50 nor mo re than $500 or by imprisonment for not more than one year, or by both such fine and impr isonment ." SEC . 8. This title shall take effect thirty days after the passage and approval of this Act . TITLE IV-REGISTRATION FEES FOR MOTOR VEHICLES SEC . 1 . As used in this title- (a) The t erm "motor veh icle" means a ny vehicle pr opelled by an internal-combustion engine or by electricity or steam, except road rollers, farm tractors, and vehicles propelled only upon stationary rails or tracks . (b) The term "person" means an individual, partnership, cor- "Perso n ." porat ion, or assoc iation . (c) The term "owner" means a person who holds the legal title to a motor vehicle or trailer the registration of which is required in the District of Columbia . If a vehicle is the subject of an agreement for the conditional sale or lease thereof with the right of purchase upon performance of the condition stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee, or if a mortgagor of a vehicle is entitled to possession, then such conditional vendee or lessee or mortgagor shall be deemed the owner for the purpose of these regulations . (d) The term "director" means the director of vehicles and traffic of t he Dist rict o f Colum bia, in cludin g assis tants o r agen ts duly desig- nated by the Commissioners . (e) The t erm "dealer" m eans any pers on engaged in the business of manufacturing, distributing, or dealing in motor vehicles . (f) The te rm "pu blic highwa y" mea ns any road , stre et, alley, or way, open to use of the public, as a matter of right, for purposes of vehicular traffic . (g) The term "trailer" means a vehicle without motor powe r intended or used for carrying property or persons and drawn or intended to be drawn by a motor vehicle, whether such vehicle without motor power carries the we ight of the p roperty or per sons wholly on its own structure or whether a part of such weight rests upon or is carried by a motor vehicle . 679 Acceptance of fuel with out required statement on invoice unlawful; exception .
