54 STAT.] 76TH CONG. , 3D SESS.-CH. 395-JUNE 18, 1940 (except salaries and expenses of employees), in accordance with the provisions of the Act of June 18, 1934 (48 Stat. 985), $325,000, together with the unexpended balance of the appropriation for this purpose for the fiscal year 1940: Provided, That in addition to the amount herein appropriated the Secretary of the Interior may also incur obligations, and enter into contracts for the acquisition of the additional land, not exceeding a total of $325,000, and his action in so doing shall be deemed a contractual obligation of the Federal Government for the payment of the cost thereof, and appropriations hereafter made for the acquisition of land pursuant to the authoriza- tion contained in the Act of June 18, 1934, shall be available for the purpose of discharging the obligation or obligations so created: Provided further, That no part of the sum herein appropriated or of this contract authorization shall be used for the acquisition of land within the States of Arizona, Colorado, New Mexico, and Wyoming outside of the boundaries of existing Indian reservations. The unexpended balance of the appropriation of $25,000 contained in the Interior Department Appropriation Act, fiscal year 1938, for the payment of taxes, including penalties and interest, assessed against individually owned Indian land, title to which is held subject to restrictions against alienation or encumbrance except with the consent or approval of the Secretary of the Interior, when such land was purchased with trust or restricted funds with the understanding that after purchase it would be nontaxable, as authorized by the Act of June 20, 1936 (49 Stat. 1542), is hereby continued available for the same purposes until June 30, 1941. Purchase of land, Confederated Bands of Utes, Utah (tribal funds): The unexpended balances of the amounts authorized to be expended by the Interior Department Appropriation Act for the fiscal year 1940 for the purchase of additional lands and improve- ments for the Confederated Bands of Ute Indians in Utah, are hereby continued available for the same purposes, and for the pur- chase of improvements on public-domain lands, until June 30, 1941. Purchase of land, Cheyenne River Reservation, South Dakota (tribal funds): The unexpended balances of the appropriations from tribal funds of the Cheyenne River Indians, South Dakota, available during the fiscal year 1940 for the purchase of Indian-owned and privately owned land, and improvements thereon, in the Cheyenne River Reservation, South Dakota, are hereby continued available for the same purposes and under the same conditions, until June 30, 1941. Purchase of land, Fort Hall Reservation, Idaho (tribal funds): The unexpended balance of the appropriation of $40,000 contained in the Second Deficiency Appropriation Act, fiscal year 1938, for the purchase of Indian-owned and privately owned lands or interests therein, and improvements thereon, payable from funds on deposit to the credit of the Fort Hall Indians, is hereby continued available, for the same purposes and under the same conditions, until June 30, 1941. Purchase of land for the Indians of the Round Valley Reservation, California (tribal funds): For the purchase of land and improve- ments thereon for the Indians of the Round Valley Reservation, California, $10,000, payable from funds on deposit to the credit of said Indians: Provided, That title to any land and improvements so purchased shall be taken in the name of the United States in trust for the Indians of the Round Valley Reservation.
