[55 STAT. suring conditions of maximum I speed for the movements required r in the defense of the American 1 Continent in matters of aviation, c and desirous of organizing a sub- 1 stantial and efficient collabora- tion by both countries in their 1 task to defend the Americas, and ; with the highest regard for their i juridical equality and respect for the sovereignty of both countries, < have agreed to permit the recip- l rocal transit of military aircraft through their territories and terri- torial waters, pursuant to the following clauses: Duration. FiRST. - The mutual concessions which the High Contracting Par- ties grant each other under this Agreement, will be effective only for the duration of the present state of possible threats of armed aggression against either of them and, if so required, in the opinion of both Governments, by the needs of their mutual defense. Free transit. SECOND. -In view of the resolu- tions of the Second Meeting of Ministers of Foreign Relations, held at Habana, the United States and Mexico will grant free transit through their respective territories and territorial waters of military airplanes and seaplanes of the other country, without restrictions as to type, number, frequency of flights, personnel or material car- ried. Advance notice of THIRD. - Each Government flight; data required. agrees to give to the other, official notice, at least twenty-four hours in advance, of the departure from its territory of any such aircraft which it is desired shall fly over the territory of the other, and such notice shall specify the number na rapidez a los movimientos que 'equiera, en materia de aviaci6n, a defensa del Continente Ameri- cano y con el deseo de organizar a colaboraci6n substancial y ,ficiente de los dos paises en su labor defensiva de las Americas y dentro de la mas estricta igualdad juridica y de respeto a la soberania de ambos paises, han convenido en permitir el trAnsito reciproco de aeroplanos militares por sus territorios y aguas terri- toriales, sujeto a las clausulas siguientes: PRIMERA.-Las concesiones mu- tuas que las Altas Partes Contra- tantes se otorgan en este Convenio solamente subsistiran mientras dure el actual estado de posibles amenazas de agresi6n armada a cualquiera de ellas y si lo re- quieren las necesidades de su mutua defensa, a juicio de ambos Gobiernos. SEGUNDA.- En atenci6n a las Resoluciones de la Segunda Re- uni6n de Consulta de Secretarios de Relaciones Exteriores, cele- brada en La Habana, tanto los Estados Unidos como Mexico con- cederan el libre transito, por sus respectivos territorios y por sobre sus aguas territoriales, de aviones e hidroaviones de guerra del otro pais, sin restricciones en cuanto al tipo, al nfmero de ellos, a la frecuencia de los vuelos y al personal o material transportados. TERCERA.- Cada uno de los Gobiernos se compromete a dar al otro, aviso oficial, por lo menos con veinticuatro horas de anticipa- ci6n, de la salida de su propio territorio de cualquiera de dichas aeronaves que se desee vuele sobre el territorio del otro, y tal aviso TREATIES 1192
