"SEC. 1632. ACTS TO BE PERFORMED BY AGENTS. "In case a fiduciary agent or other person has the control, receipt, custody, or disposal of, or pays the wages of an employee or group of employees, employed by one or more employers, the Commissioner, under regulations prescribed by him with the approval of the Secre- tary, is authorized to designate such fiduciary, agent or other person to perform such acts as are required of employers under this chapter and as the Commissioner may specify. Except as may be otherwise prescribed by the Commissioner with the approval of the Secretary, all provisions of law (including penalties) applicable in respect of an employer shall be applicable to a fiduciary, agent or other person so designated but, except as so provided, the employer for whom such fiduciary, agent or other person acts shall remain subject to the pro- visions of law (including penalties) applicable in respect of employers." (b) TECHNICAL AMENDMENTS. - (1) AMENDMENT TO SECTION 34.-Section 34 of the Internal Revenue Code (cross reference) is amended by striking out "453, 454, and 466 (e)" and inserting in lieu thereof "453 and 454". (2) AMENDMENT TO SECTION 322. - Section 322 (f) of the Inter- nal Revenue Code (cross reference) is amended to read as follows: "(f) TAX WIT ELD AT SOURCE.-For refund or credit in case of withholding agent, see section 143 (f). For refund or credit in case of employer required to deduct and withhold tax on wages, see section 1622 (f)." (c) EXPIRATION DATE FOR WrrHOLDINO AT SOURCE ON WAaGE UNDER SUBCHAPTER D OF CHAPTER 1.- Section 476 of the Internal Revenue Code (prescribing the expiration date for the taxes imposed by Subchapter D) is amended to read as follows: "SEC. 476. EXPIRATION DATE. "The tax imposed by Part I of this subchapter shall not apply with respect to any taxable year commencing after the date of cessation of hostilities in the present war. The tax imposed by Part II of such subchapter shall not apply with respect to any wages paid after June 30, 1943, unless paid during the calendar year 1943 with respect to a payroll period beginning on or before such date." (d) EFFECTIVE DATE.- The amendments made by subsections (a) and (b) shall take effect July 1, 1943, and shall be applicable to all wages paid on or after such date, except that such amendments shall not be applicable to wages paid during the calendar year 1943 with respect to a payroll period beginning before such date.
