C . 1940, title 28, sec. 1, note), entitled "An Act to pro- vide for the appointment of additional district and circuit judges", be, and it is hereby, amended to read as follows: "(a) Provided,That the first vacancy occurring in the office of district judge in each of said districts, except the district of New Jersey, shall not be filled."
