Officers: acceptance of appointment in higher grade (a) An officer who is promoted to a temporary grade is considered to nave accepted his promotion on the date of the order announcing it, unless he expressly declines the promotion. He is entitled to the pay and allowances of the higher grade from that date, unless entitled to them from an earlier date under another provision of law. §8491. Non-regular officers: status A commissioned officer of the Air Force, other than of the Regular Air Force, who is on active duty in any commissioned grade has the rights and privileges, and is entitled to the beneiits, provided by law for a commissioned officer of the Air Force Reserve— (1) whose ressrve grads is that in which the officer not of the Regular Air Force is serving; (2) who has the same length of service as the officer not of the Regular Air Force; and (3) who is on active duty in his reserve grade. § 8492. Members: service extension during war Unless terminated at an earlier date by the President, the period of active duty of any membar of the Air Force is extended for the duration of any war in which the United States may be engaged and for six months thereafter. § 8495. Air National Guard of United States: status Members of the Air National Guard of the United States are not in active Federal service except when ordered thereto under law. § 8496. Air National Guard of United States: commissioned officers; duty in National Guard Bureau (a) The President may, with their consent, order commissioned officers of the Air National Guard of the United States to active duty in the National Guard Bureau. (b) The number of officers of the Air National Guard of the United States in any grade below brigadier general who are ordered to active duty in the National Guard Bureau may not be more than 40 percent
