" (C) service described in section 3121(b) (11), (12), or (15) performed in the United States (as defined in section 3121 (e)(2)) by a citizen of the United States, and " (D) service described in paragraph (4) of this subsection;", (c) The amendments made by this section shall apply only with respect to taxable years ending on or after December 31, 1960; except that for purposes of section 203 of the Social Security Act, the amendment made by subsection (a) shall apply only with respect to taxable years (of the individual performing the service involved) beginning after the date of the enactment of this Act. SEC. 201. (a) Section 202(d)(1)(C) of the Social Security Act is amended to read as follows: " (C) was dependent upon such individual— " (i) if such individual is living, at the time such application was filed, "(ii) if such individual has died, at the time of such death, or "(iii) if such individual had a period of disability which continued until he became entitled to old-age or disability insurance benefits, or (if he has died) until the month of his death, at the beginning of such period of disability or at the time he became entitled to such benefits,". (b) Section 202(d)(1) of such Act is further amended by adding at the end thereof the following new sentence: "In the case of an individual entitled to disability insurance benefits, the provisions of clause (i) of subparagraph (C) of this paragraph shall not apply to a child of such individual unless he (A) is the natural child or stepchild of such individual (including such a child who was legally adopted by such individual) or (B) was legally adopted by such individual before the end of the twenty-four month period beginning with the month after the month in which such individual most recently became entitled to disability insurance benefits, but only if (i) proceedings for such adoption of the child had been instituted by such individual in or before the month in which began the period of disability of such individual which still exists at the time of such adoption or (ii) such adopted child was living with such individual in such month." (c) The amendments made by this section shall apply as though this Act had been enacted on August 28, 1958, and with respect to monthlv benefits under section 202 of the Social Security Act for months after August 1958 based on applications for such benefits filed on or after August 28, 1958. SEC. 202. (a) Section 202(d)(3) of the Social Security Act is amended by striking out subparagraph (C), and by striking out ", or" at the end of subparagraph (B) and inserting in lieu thereof a period. (b) The amendments made by subsection (a) shall apply with respect to monthly benefits under section 202 of the Social Security Act for months beginning with the month in which this Act is enacted, but only if an application for such benefits is filed in or after such month.
