To authorize the Secretary of Transportation to release restrictions On the use of certain property conveyed to the city of Ellchart, Kansas, for airport purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That, notwithstanding section 16 of the Federal A i r p o r t Act (as in effect on March 11, 1958^, the Secretary of Transportation is authorized, subject to the provisions of section 4 of the Act of October 1, 1949 (50 A p p. U.S.C. 1622c), and the provisions of section 2 of this Act, to g r a n t releases from any of the terms, conditions, reservations, and restrictions contained in the deed of conveyance dated March 11, 1958, under which the United States conveyed certain property to the city of E l k h a r t, Kansas, for airport purposes. SEC. 2. Any release granted by the Secretary of Transportation under the first section of this Act shall be subject to the following conditions: (1) The city of E l k h a r t, Kansas, shall agree that in conveying any interest in the property which the United States conveyed to the city by deed dated March 11, 1958, the city will receive an amount for such interest which is equal to the fair market value (as determined pursuant to regulations issued by such Secretary). (2) Any such amount so received by the city shall be used by the city for the development, improvement, operation, or maintenance of a public airport. Approved February 27, 1976.
