Grant or contract. " SEC. 202. (a) The Secretary may make a g r a n t or award a contract 20 USC 2882. under this part only upon the submission of an application by an eligible entity at the time and in the form prescribed by the Secretary. E a c h such application by a State or local educational agency shall provide assurances that— " (1) in designing the proposal for which application is made, the needs of children in nonprofit private elementary and secondary schools have been taken into account through consultation with private school officials; and, to the maximum extent feasible, and consistent with the number of such children in the area to be served who have the educational needs the proposal is intended to address, those children will be provided an opportunity to participate in the proposed activity on a basis comparable to that provided for public school children; " (2) procedures have been developed to evaluate the effectiveness of the proposed activity in achieving the purposes of this title; and " (3) procedures have been developed for incorporating successful practices developed with assistance under this title into the regular instructional program. " (b) No g r a n t or contract may be awarded to a local educational agency under this part unless the appropriate State educational agency has been provided an opportunity for at least thirty days to comment on the application. " SEC. 203. Notwithstanding the provisions of section 408(a)(3) of the General Education Provisions Act, the Secretary may accept, on behalf of the United States, conditional or unconditional gifts or donations of services, money, or property, made for any activities authorized to be carried out under this title. " SEC. 204. (a) I n order to achieve the purposes of this part, the Secretary is authorized, during the period of October 1, 1979, through September 30, 1983, to make g r a n t s to, and enter into contracts with. State and local educational agencies, and other public and private agencies, organizations, and institutions to carry out planning, research, development, demonstrations (including t r a i n i n g of leadership personnel, evaluation, and dissemination, as described in sections 205 through 209), except that no g r a n t may be made under this part to other than a public or nonprofit private agency, organization, or institution. " (b) The Secretary may provide to such agencies, organizations, and institutions, either directly or through g r a n t s or contracts, technical assistance related to the purposes of this part. a INSTRUCTION I N BASIC SKILLS

The Secretary shall provide assistance, in accordance with section 204, for activities designed to demonstrate improved delivery of instructional services in the areas of reading, mathematics, and oral and written communication, including— " (1) assessment of schoolwide needs to identify the instructional needs of children in basic skills;
