Secretary under chapter 123 of this title; (2) a cooperative boating safety assistance program with the Coast Guard in that State; (3) sufficient patrol and other activity to ensure adequate enforcement of applicable State boating safety laws and regulations; (4) an adequate State boating safety education program; and (5) a system, approved by the Secretary, for reporting marine casualties required under section 6102 of this title. (d) The Secretary shall approve a State recreational boating facili- ties improvement program, and the program is eligible to receive amounts authorized to be expended under section 13106 of this title, if the program includes— (1) a complete description of recreational boating facility improvement projects to be undertaken by the State; and (2) consultation with State officials responsible for the statewide comprehensive outdoor recreation plan required by the Land and Water Conservation Fund Act of 1965 (16 U.S.C. 16 USC 460Z-4 — 4601-4—4601-11) and for any program developed under the 460M1. Coastal Zone Management Act of 1972 (16 U.S.C. 1451-1464). (e) The Secretary's approval under this section is a contractual obligation of the Government for the payment of the proportional share of the cost of carrying out the program. Combined (f)(1) A State may submit a combined program to the Secretary for program, the improvement of recreational boating safety and the improve- submittai. ment of recreational boating facilities in that State. The Secretary shall approve the program if it contains the minimum requirements set forth in subsections (c) and (d) of this section, (2) Those parts of the combined program of a State that are designed to improve recreational boating safety are eligible to re- ceive amounts authorized to be expended for State recreational boating safety programs under section 13106 of this title. The Secre- tary's approval of those parts is a contractual obligation of the Government for the payment of the proportional share of the cost of carrying out the States recreational boating safety program under this chapter. (3) Those parts of the combined program of a State that are designed to improve recreational boating facilities are eligible to receive amounts authorized to be expended for State recreational boating facilities improvement programs under section 13106 of this title. The Secretary's approval of those parts is a contractual obliga- tion of the Government for the payment of the proportional share of the cost of carrying out the State's recreational boating facilities program under this chapter. § 13103. Allocations (a) The Secretary shall allocate amounts available for allocation and distribution under this chapter for State recreational boating safety programs as follows: (1) One-third shall be allocated equally each fiscal year among eligible States. (2) One-third shall be allocated among eligible States that maintain a State vessel numbering system approved under chapter 123 of this title and a marine casualty reporting system
