Classification of National Laws and Regulations of the People's Republic of China

Laws

Constitution The most authoritative law in China.
Laws Enactments by the National People's Congress or the Standing Committee of the National People's Congress (NPCSC). According to Article 62 of the Constitution, only the National People's Congress has the power to enact and amend basic laws on criminal law, civil law, national organs and other basic laws. According to Article 67 of the Constitution, The NPCSC may enact laws other than basic laws. It may also add to or amend basic laws, provided that the principles of the law are not violated.
Legal interpretations According to Article 42 of the Legislative Law of the People's Republic of China, the NPCSC can explain laws when a law requires further clarification or when new circumstances have arisen after a law is enacted and the law's application needs ascertainment. According to Article 47 of the Legislation Law, legal interpretations have the same legal effect as laws.

Judicial interpretations Interpretations on the application of law by the Supreme People's Court and the Supreme People's Procuratorate.
Administrative regulations National regulations issued by the State Council.
Departmental rules Rules issued by constituent departments or direct subordinate organisations of the State Council.
