พระบาทสมเด็จพระปรมินทรมหาภูมิพลอดุลยเดช มีพระบรมราชโองการโปรดเกล้าฯ ให้ประกาศว่า

Phra Bat Somdet Phra Paramin Maha Bhumibol Adulyadej has issued with his pleasure a great royal command that it be proclaimed as follows:

โดยที่เป็นการสมควรแก้ไขเพิ่มเติมประมวลกฎหมายอาญา

Whereas it is appropriate to amend the Penal Code;

จึงทรงพระกรุณาโปรดเกล้าฯ ให้ตราพระราชบัญญัติขึ้นไว้ โดยคำแนะนำและยินยอมของสภานิติบัญญัติแห่งชาติ ดังต่อไปนี้

Therefore, he grants with his gracious pleasure, by and with the advice and consent of the National Legislative Assembly, the enactment of the following Act:

มาตรา⁠๑⁠พระราชบัญญัตินี้เรียกว่า "พระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๑๘) พ.ศ. ๒๕๕๐"

Section⁠1.⁠This Act is called the “Act Amending the Penal Code (No. 18), 2550 BE”.

มาตรา⁠๒⁠พระราชบัญญัตินี้ให้ใช้บังคับตั้งแต่วันถัดจากวันประกาศในราชกิจจานุเบกษาเป็นต้นไป

Section⁠2.⁠This Act shall come into as force from the day following the date of its publication in the Government Gazette onwards.

มาตรา⁠๓⁠ให้เพิ่มความต่อไปนี้เป็น (๑๕) ของมาตรา ๑ แห่งประมวลกฎหมายอาญา

Section⁠3.⁠The following text shall be inserted in the Penal Code as (15) of its section 1:

"(๑๕)⁠"หนังสือเดินทาง" หมายความว่า เอกสารสำคัญประจำตัว ไม่ว่าจะมีรูปลักษณะใด ที่รัฐบาลไทย รัฐบาลต่างประเทศ หรือองค์การระหว่างประเทศ ออกให้แก่บุคคลใด เพื่อใช้แสดงตนในการเดินทางระหว่างประเทศ และให้หมายความรวมถึง เอกสารใช้แทนหนังสือเดินทาง และแบบหนังสือเดินทางที่ยังไม่ได้กรอกข้อความเกี่ยวกับผู้ถือหนังสือเดินทางด้วย"

“(15)⁠“passport” means an evidential[1] document of identification[2] which is issued in whatever form by the Thai Government, a foreign government, or an international organisation to any person to be used in identifying himself during an international travel,[3] and shall also include a document which is used as a substitute for a passport and a passport form in which the information about the passport bearer has not yet been filled”.

มาตรา⁠๔⁠ให้เพิ่มความต่อไปนี้เป็น (๒/๒) ของมาตรา ๘ แห่งประมวลกฎหมายอาญา

Section⁠4.⁠The following text shall be inserted in the Penal Code as (2/2) of its section 8:

"(๒/๒)⁠ความผิดเกี่ยวกับหนังสือเดินทาง ตามที่บัญญัติไว้ในมาตรา ๒๖๙/๘ ถึงมาตรา ๒๖๙/๑๕"

“(2/2)⁠offences relating to passports, as provided in section 269/8 through section 269/15”.

มาตรา⁠๕⁠ให้เพิ่มความต่อไปนี้เป็นหมวด ๕ ความผิดเกี่ยวกับหนังสือเดินทาง มาตรา ๒๖๙/๘ มาตรา ๒๖๙/๙ มาตรา ๒๖๙/๑๐ มาตรา ๒๖๙/๑๑ มาตรา ๒๖๙/๑๒ มาตรา ๒๖๙/๑๓ มาตรา ๒๖๙/๑๔ และมาตรา ๒๖๙/๑๕ ของลักษณะ ๗ ความผิดเกี่ยวกับการปลอมและการแปลง ในภาค ๒ ความผิด แห่งประมวลกฎหมายอาญา

Section⁠5.⁠The following text shall be inserted in Division 2 Offences, of the Penal Code, as Chapter 5 Offences relating to passports, section 269/8, section 269/9, section 269/12, section 269/11, section 269/12, section 269/13, section 269/14, and section 269/15 of its Title 7 Offences relating to counterfeiting and alteration:

"หมวด ๕ ความผิดเกี่ยวกับหนังสือเดินทาง

“Chapter 5 Offences relating to passports

มาตรา ๒๖๙/๘ ผู้ใดทำหนังสือเดินทางปลอมขึ้นทั้งฉบับหรือแต่ส่วนหนึ่งส่วนใด เติมหรือตัดทอนข้อความ หรือแก้ไขด้วยประการใด ๆ ในหนังสือเดินทางที่แท้จริง หรือประทับตราปลอมหรือลงลายมือชื่อปลอมในหนังสือเดินทาง โดยประการที่น่าจะเกิดความเสียหายแก่ผู้อื่นหรือประชาชน ถ้าได้กระทำเพื่อให้ผู้หนึ่งผู้ใดหลงเชื่อว่าเป็นหนังสือเดินทางที่แท้จริง ผู้นั้นกระทำความผิดฐานปลอมหนังสือเดินทาง ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบปี และปรับตั้งแต่สองหมื่นบาทถึงสองแสนบาท

Section⁠269/8.⁠[When] anyone, in a manner that is likely to cause injury to another or the people, produces[4] a passport [that is] counterfeit, [whether] in whole or merely in any particular part, adds [any information to], or expurgates [any] information [from], or makes whatever edits to[5] a genuine passport, or sets a counterfeit seal or affixes a counterfeit signature to a passport, that one, if doing [so] in order to deceive any particular person into erroneously believing that the passport is genuine, commits an offence of passport counterfeiting [and] incurs a penalty of imprisonment from one year to ten years and fine from twenty thousand baht to two hundred thousand baht.

มาตรา ๒๖๙/๙ ผู้ใดใช้หรือมีไว้เพื่อใช้ซึ่งหนังสือเดินทางปลอมตามมาตรา ๒๖๙/๘ ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบปี และปรับตั้งแต่สองหมื่นบาทถึงสองแสนบาท

Section⁠269/9.⁠Anyone who uses or possesses for use a counterfeit passport according to section 269/8 incurs a penalty of imprisonment from one year to ten years and fine from twenty thousand baht to two hundred thousand baht.

ผู้ใดจำหน่ายหรือมีไว้เพื่อจำหน่ายซึ่งหนังสือเดินทางปลอมตามมาตรา ๒๖๙/๘ ต้องระวางโทษจำคุกตั้งแต่สามปีถึงยี่สิบปี และปรับตั้งแต่หกหมื่นบาทถึงสี่แสนบาท

Anyone who disposes of[6] or possesses for disposal a counterfeit passport according to section 269/8 incurs a penalty of imprisonment from three years to twenty years and fine from sixty thousand baht to four hundred thousand baht.

การมีหนังสือเดินทางปลอมตามมาตรา ๒๖๙/๘ จำนวนตั้งแต่สองฉบับขึ้นไป ให้สันนิษฐานไว้ก่อนว่า มีไว้เพื่อจำหน่าย

The possession of two or more counterfeit passports according to section 269/8 shall, in the first place, be presumed to be the possession for disposal.

ถ้าผู้กระทำความผิดตามวรรคหนึ่งหรือวรรคสองเป็นผู้ปลอมซึ่งหนังสือเดินทางตามมาตรา ๒๖๙/๘ ให้ลงโทษตามมาตรานี้แต่กระทงเดียว

If the offender under paragraph 1 or paragraph 2 is the person counterfeiting the passport in accordance with section 269/18, [the offender] shall be imposed with the penalty under this section on a single count only.

มาตรา ๒๖๙/๑๐ ผู้ใดนำเข้าในหรือส่งออกไปนอกราชอาณาจักรซึ่งหนังสือเดินทางปลอมตามมาตรา ๒๖๙/๘ ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบปี และปรับตั้งแต่สองหมื่นบาทถึงสองแสนบาท

Section⁠269/10.⁠Anyone who brings into or sends out of the Kingdom a counterfeit passport according to section 269/8 incurs a penalty of imprisonment from one year to ten years and fine from twenty thousand baht to two hundred thousand baht.

ถ้าการกระทำความผิดตามวรรคหนึ่งได้กระทำไปเพื่อจำหน่าย ต้องระวางโทษจำคุกตั้งแต่สามปีถึงยี่สิบปี และปรับตั้งแต่หกหมื่นบาทถึงสี่แสนบาท

If the offence under paragraph 1 is committed[7] for [the purpose of] disposal,[6] [the offender] incurs a penalty of imprisonment from three years to twenty years and fine from sixty thousand baht to four hundred thousand baht.

มาตรา ๒๖๙/๑๑ ผู้ใดใช้หนังสือเดินทางของผู้อื่นโดยมิชอบ ในประการที่น่าจะก่อให้เกิดความเสียหายแก่ผู้อื่นหรือประชาชน ต้องระวางโทษจำคุกไม่เกินสิบปี และปรับไม่เกินสองแสนบาท

Section⁠269/11.⁠Anyone who wrongfully uses a passport of another in a manner that is likely to cause injury to another or the people, incurs a penalty of imprisonment not over ten years and fine not over two hundred thousand baht.

ผู้ใดจัดหาหนังสือเดินทางให้ผู้กระทำความผิดตามวรรคหนึ่ง ต้องระวางโทษเช่นเดียวกัน

Anyone who procures a passport for the offender under paragraph 1 incurs the same penalty.

มาตรา ๒๖๙/๑๒ ผู้ใดทำปลอมขึ้นซึ่งดวงตรา รอยตรา หรือแผ่นปะตรวจลงตราอันใช้ในการตรวจลงตราสำหรับการเดินทางระหว่างประเทศ ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบปี และปรับตั้งแต่สองหมื่นบาทถึงสองแสนบาท

Section⁠269/12.⁠Anyone who counterfeits a seal, seal impression, or visa sticker which is used in a visa [process] for international travel, incurs a penalty of imprisonment from one year to ten years and fine from twenty thousand baht to two hundred thousand baht.

มาตรา ๒๖๙/๑๓ ผู้ใดใช้ดวงตรา รอยตรา หรือแผ่นปะตรวจลงตราที่ทำปลอมขึ้นตามมาตรา ๒๖๙/๑๒ ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบปี และปรับตั้งแต่สองหมื่นบาทถึงสองแสนบาท

Section⁠269/13.⁠Anyone who uses a seal, seal impression, or visa sticker which has been counterfeited in accordance with section 269/12 incurs a penalty of imprisonment from one year to ten year and fine from twenty thousand baht to two hundred thousand baht.

ถ้าผู้กระทำความผิดตามวรรคหนึ่งเป็นผู้ปลอมซึ่งดวงตรา รอยตรา หรือแผ่นปะตรวจลงตราตามมาตรา ๒๖๙/๑๒ ให้ลงโทษตามมาตรานี้แต่กระทงเดียว

If the offender under paragraph 1 is the person counterfeiting the seal, seal impression, or visa sticker in accordance with section 269/12, [the offender] shall be imposed with the penalty under this section on a single count only.

มาตรา ๒๖๙/๑๔ ผู้ใดนำเข้าในหรือส่งออกไปนอกราชอาณาจักรซึ่งดวงตรา รอยตรา หรือแผ่นปะตรวจลงตราซึ่งระบุไว้ในมาตรา ๒๖๙/๑๒ อันเป็นของปลอม ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบปี และปรับตั้งแต่สองหมื่นบาทถึงสองแสนบาท

Section⁠269/14.⁠Anyone who brings into or sends out of the Kingdom a counterfeit seal, seal impression, or visa sticker as specified in section 269/12[8] incurs a penalty of imprisonment from one year to ten years and fine from twenty thousand baht or two hundred thousand baht.

มาตรา ๒๖๙/๑๕ ผู้ใดใช้ดวงตรา รอยตรา หรือแผ่นปะตรวจลงตราอันแท้จริงที่ใช้ในการตรวจลงตราสำหรับการเดินทางระหว่างประเทศโดยมิชอบ ในประการที่น่าจะก่อให้เกิดความเสียหายแก่ผู้อื่นหรือประชาชน ต้องระวางโทษสองในสามส่วนของโทษที่บัญญัติไว้ในมาตรา ๒๖๙/๑๓"

Section⁠269/15.⁠Anyone who, in a manner that is likely to cause injury to another or the people, wrongfully uses a genuine seal, seal impression, or visa sticker which is used in a visa [process] for international travel, incurs two thirds of the penalty provided in section 269/13.”

หมายเหตุ :- เหตุผลในการประกาศใช้พระราชบัญญัติฉบับนี้ คือ โดยที่ปัจจุบันการก่อการร้ายและอาชญากรรมข้ามชาติได้ทวีความรุนแรงและมีรูปแบบที่ซับซ้อนมากยิ่งขึ้น และได้มีการใช้หนังสือเดินทางเป็นเครื่องมือในการกระทำดังกล่าว ซึ่งส่งผลกระทบต่อความมั่นคงภายในประเทศและต่อความสัมพันธ์ระหว่างประเทศ สมควรขยายขอบเขตของการกระทำความผิดเกี่ยวกับหนังสือเดินทางให้กว้างขึ้น และสมควรกำหนดอัตราโทษให้เหมาะสมกับความผิด จึงจำเป็นต้องตราพระราชบัญญัตินี้

Note: The grounds for promulgation of this Act are as follows: Whereas now terrorism and transnational crimes have greatly increased [in terms of] intensity and complexity of forms, in which passports have been used as an instrument of the commission, resulting in an impact upon national security of the Country and international relations, it is appropriate to extend the scope of the offences relating to passports and it is appropriate to designate rates of penalty which are suitable for the offences. Therefore, it is necessary to enact this Act.

1. Samnak-ngan Ratchabandittayasapha (2013) defines samkhan (Thai: สำคัญ) as (1) n. token, mark, sign, note, indication; (2) adj. remarkable, significant, notable; valuable, precious; special, exceptional; (3) v. to understand or believe (groundlessly or incorrectly). Because a document that is samkhan is one that serves as a token (mark, indication, proof, etc) of something, the term samkhan is here translated as “evidential”.
2. Pracham tua (Thai: ประจำตัว) literally translates “attached to person” (personal), but it is often translated as “identification” or “identity”. For instance, lek pracham tua prachachon (Thai: เลขประจำตัวประชาชน; literally “citizen’ personal number”) is translated as “national identification number”, and bat pracham tua nak-rian (Thai: บัตรประจำตัวนักเรียน; literally “student′s personal card”), as “student identity card”.
