Amending the Penal Code (No. 4),

Being the 34th year of the present reign

Phra Bat Somdet Phra Paramin Maha Bhumibol Adulyadej gives a great royal command by which He orders with His pleasure that it be announced as follows:

Whereas it is appropriate to amend the Penal Code;

Therefore, by and with the advice and consent of the National Legislative Assembly acting as the National Assembly, He orders with His gracious pleasure that the following Act be enacted:

Section1.This Act is called the "Act Amending the Penal Code (No. 4), 2522 BE".

Section2.This Act shall come into force from the day following the day of its publication in the Royal Gazette onwards.

Section3.The stipulations of section 271 of the Penal Code shall be repealed and replaced by the following stipulations:

"Section271.Whoever sells goods by deceiving a buyer into erroneously believing in the false origin, condition, quality, or quantity of the goods by any means, shall be punished with imprisonment not over three years, or a fine not over six thousand baht, or both the imprisonment and the fine, if such act does not constitute an offence of defrauding."

Note: The grounds for promulgation of this Act are as follows: Since the selling of goods by deceiving buyers into erroneously believing in the false origin, condition, quality, or amount thereof is now increasing and, as prescribed in section 271 of the Penal Code, this kind of offence is compoundable, competent officials of the State cannot bring cases against the offenders if without complaints from injured persons, and competent officials dare not arrest those who offer the said goods for sale if without complaints from injured persons even when it appears to the competent officials that the offers are made to the general public in shops or public places, thus causing the suppression of this offence to be not as successful as it should be. It is appropriate to amend section 271 anew by designating the offence under the mentioned section as an uncompoundable offence, so that competent officials of the State would be empowered to arrest those who commit the said offence, without having to obtain complaints from injured persons; and it is appropriate to heighten the punishment for this offence so as to daunt offenders. Therefore, it is necessary to enact this Act up.
