รัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช ๒๕๕๗ แก้ไขเพิ่มเติม (ฉบับที่ ๔) พุทธศักราช ๒๕๖๐ สมเด็จพระเจ้าอยู่หัวมหาวชิราลงกรณ บดินทรเทพยวรางกูร ให้ไว้ ณ วันที่ ๑๕ มกราคม พ.ศ. ๒๕๖๐ เป็นปีที่ ๒ ในรัชกาลปัจจุบัน สมเด็จพระเจ้าอยู่หัวมหาวชิราลงกรณ บดินทรเทพยวรางกูร มีพระราชโองการโปรดเกล้าฯ ให้ประกาศว่า โดยที่เป็นการสมควรแก้ไขเพิ่มเติมรัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช ๒๕๕๗ จึงทรงพระกรุณาโปรดเกล้าฯ ให้ตรารัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช ๒๕๕๗ แก้ไขเพิ่มเติม ขึ้นไว้ ดังต่อไปนี้

Amendment to the Constitution of the Kingdom of Thailand (Interim) 2014 (No. 4) 2017 His Majesty the Grand Vajiralongkorn, the Sacred Lord Over All Heads, the Holy Hallowed Descendant of the Great Indra. Given this 15th Day of January, 2017, Being the 2nd Year of the Present Reign. His Majesty the Grand Vajiralongkorn, the Sacred Lord Over All Heads, the Holy Hallowed Descendant of the Great Indra, showing mercy upon all heads, made a sacred royal command that the following proclamation be issued: Whereas it is desirable to amend the Constitution of the Kingdom of Thailand (Interim) 2014; Now, therefore, His Majesty, expressing his sacred kindness through mercy upon all heads, has an amendment to the Constitution of the Kingdom of Thailand (Interim) 2014 established as follows:

มาตรา ๑ รัฐธรรมนูญนี้เรียกว่า "รัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช ๒๕๕๗ แก้ไขเพิ่มเติม (ฉบับที่ ๔) พุทธศักราช ๒๕๖๐"	Section 1 This Amendment is called the Amendment to the Constitution of the Kingdom of Thailand (Interim) 2014 (No. 4) 2017.

มาตรา ๒ รัฐธรรมนูญนี้ให้ใช้บังคับตั้งแต่วันถัดจากวันประกาศในราชกิจจานุเบกษาเป็นต้นไป	Section 2 This Amendment shall come into force as from the day following the date of its publication in the Government Gazette.[2.1]

มาตรา ๓ ให้เพิ่มความต่อไปนี้เป็นวรรคสามของมาตรา ๒ ของรัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช ๒๕๕๗ "ในเมื่อพระมหากษัตริย์จะไม่ประทับอยู่ในราชอาณาจักรหรือจะทรงบริหารพระราชภาระไม่ได้ด้วยเหตุใดก็ตาม จะทรงแต่งตั้งผู้ใดผู้หนึ่งเป็นผู้สำเร็จราชการแทนพระองค์หรือไม่ก็ได้ และให้ประธานรัฐสภาเป็นผู้ลงนามรับสนองพระบรมราชโองการแต่งตั้ง และเมื่อกรณีเป็นไปตามมาตรานี้แล้ว มิให้นำความในมาตรา ๑๘ มาตรา ๑๙ และมาตรา ๒๐ ของรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช ๒๕๕๐ มาใช้บังคับ"

Section 3 The following shall be inserted into the Constitution of the Kingdom of Thailand (Interim) 2014 as paragraph 3 of its section 2: 'When the Monarch will not reside within the Kingdom or will be unable to manage his royal burden for any reason whatsoever, he may or may not appoint any particular person as Regent, and the President of the National Assembly shall countersign the appointment. And when the case has been handled in accordance with this section, the provisions of section 18, section 19, and section 20 of the Constitution of the Kingdom of Thailand 2007 shall not be applied.'

มาตรา ๔ ให้ยกเลิกความในวรรคสิบเอ็ดของมาตรา ๓๙/๑ ของรัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช ๒๕๕๗ ซึ่งแก้ไขเพิ่มเติมโดย รัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช ๒๕๕๗ แก้ไขเพิ่มเติม (ฉบับที่ ๒) พุทธศักราช ๒๕๕๙ และให้ใช้ความต่อไปนี้แทน "เมื่อนายกรัฐมนตรีนำร่างรัฐธรรมนูญขึ้นทูลเกล้าทูลกระหม่อมถวายตามวรรคเก้าประกอบกับวรรคสิบแล้ว หากมีกรณีที่พระมหากษัตริย์พระราชทานข้อสังเกตว่า สมควรแก้ไขเพิ่มเติมข้อความใด ภายในเก้าสิบวัน ให้นายกรัฐมนตรีขอรับพระราชทานร่างรัฐธรรมนูญนั้นคืนมา เพื่อดำเนินการแก้ไขเพิ่มเติมเฉพาะประเด็นตามข้อสังเกตนั้นและประเด็นที่เกี่ยวเนื่อง และแก้ไขเพิ่มเติมคำปรารภของร่างรัฐธรรมนูญให้สอดคล้องกัน แล้วให้นายกรัฐมนตรีนำร่างรัฐธรรมนูญที่แก้ไขเพิ่มเติมขึ้นทูลเกล้าทูลกระหม่อมถวายใหม่ภายในสามสิบวันนับแต่วันที่ได้รับพระราชทานคืนมาตามที่ขอ เมื่อนายกรัฐมนตรีนำร่างรัฐธรรมนูญที่แก้ไขเพิ่มเติมขึ้นทูลเกล้าทูลกระหม่อมถวาย และทรงลงพระปรมาภิไธยแล้ว ให้ประกาศในราชกิจจานุเบกษาและใช้บังคับได้ โดยให้นายกรัฐมนตรีลงนามรับสนองพระบรมราชโองการ ในกรณีที่พระมหากษัตริย์ไม่ทรงเห็นชอบด้วยกับร่างรัฐธรรมนูญหรือร่างรัฐธรรมนูญที่แก้ไขเพิ่มเติม และพระราชทานคืนมา หรือเมื่อพ้นเก้าสิบนับแต่วันที่นายกรัฐมนตรีนำร่างรัฐธรรมนูญหรือร่างรัฐธรรมนูญที่แก้ไขเพิ่มเติม แล้วแต่กรณี ขึ้นทูลเกล้าทูลกระหม่อมถวายแล้วมิได้พระราชทานคืนมา ให้ร่างรัฐธรรมนูญหรือร่างรัฐธรรมนูญที่แก้ไขเพิ่มเติมนั้นเป็นอันตกไป"

Section 4 The provision of paragraph 11 of section 39/1 of the Constitution of the Kingdom of Thailand (Interim) 2014, which has been amended by the Amendment to the Constitution of the Kingdom of Thailand (Interim) 2014 (No. 2) 2016, shall be repealed and replaced by the following: 'When the Prime Minister has presented the draft constitution to the Monarch according paragraph 9 in conjunction with paragraph 10, if there is a case in which the Monarch offers within ninety days an observation that any statement should be amended, the Prime Minister shall request royal permission to take the draft constitution back for initiation of specific amendments to the issues according to such observation and the related issues, as well as amendments to the preamble of the draft constitution in line therewith. Then the Prime Minister shall again present the amended draft constitution to the Monarch within thirty days reckoned from the date he receives the draft which the Monarch sends back to him at his request. Once the Prime Minister has presented the amended draft constitution the Monarch and the latter has affixed his royal signature to it, it can be published in the Government Gazette and take effect; prescribed that it shall be the Prime Minister who countersigns it. In the event that the Monarch disapproves the draft constitution or amended draft constitution and sends it back, or when he does not send it back still despite expiry of ninety days reckoned from the date the Prime Minister presents him with the draft constitution or amended draft constitution, as the case may be, that draft constitution or amended draft constitution shall lapse.'

หมายเหตุ เหตุผลในการประกาศใช้รัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช ๒๕๕๗ แก้ไขเพิ่มเติมฉบับนี้ คือ ตามที่นายกรัฐมนตรีได้นำร่างรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช .... ขึ้นทูลเกล้าฯ ถวายเพื่อทรงพิจารณานั้น ต่อมา คณะรัฐมนตรีและคณะรักษาความสงบแห่งชาติได้พิจารณาร่วมกันเห็นว่า สมควรแก้ไขเพิ่มเติมรัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช ๒๕๕๗ จึงจำเป็นต้องตรารัฐธรรมนูญฉบับนี้

Statement of grounds The grounds for promulgation of this Amendment to the Constitution of the Kingdom of Thailand (Interim) 2014 are as follows: After the Prime Minister presented the Draft Constitution of the Kingdom of Thailand .... to His Majesty for consideration, the Council of Ministers and the National Council for Peace and Order held a joint deliberation and entertained an opinion that it was expedient to amend the Constitution of the Kingdom of Thailand (Interim) 2014. It is therefore necessary to enact this Amendment.[sog.1]

'After the Prime Minister presented the Draft Constitution of the Kingdom of Thailand .... to His Majesty for consideration, the Council of Ministers and the National Council for Peace and Order held a joint deliberation and entertained an opinion that it was expedient to amend the Constitution of the Kingdom of Thailand (Interim) 2014 so as to allow the draft constitution that has been presented to His Majesty to be taken back and further amended only in respect of the issues according to the notification of the Office of His Majesty's Principal Private Secretary before being presented to His Majesty again within a fixed period of time. It is therefore necessary to enact this Amendment.'
