ANNOUNCEMENT OF THE COUNCIL FOR DEMOCRATIC REFORM
No. 21
Re: Ban on interception of telephones or other communication devices

THE COUNCIL FOR DEMOCRATIC REFORM,
WHEREAS there have been unlawful interception, employment or disclosure of any information communicated through telephone or other communication devices which infringe the personal liberty of communication and cause suspicion amongst the people employing communication devices;
THEREFORE, in order to protect the personal liberty of lawful communication and to preserve national law and order;
HEREBY, DECREED:
Clause 1
Any person who intercepts, employs or discloses an information communicated through telephone or other communication device without lawful authority shall be liable to imprisonment for a term not exceeding five years, or to a fine of not exceeding one hundred thousand baht or to both.
Clause 2
Any person who has obtained an information from the commission of the offence under clause 1 and, without lawful authority, employs or discloses before a third party such information, shall be liable to imprisonment for a term not exceeding five years, or to a fine of not exceeding one hundred thousand baht or to both.
Clause 3
Whoever employs another person to commit the offence under clause 1 or 2 shall be liable to twice heavier penalties than those prescribed for the offence under clause 1 or 2, as the case may be.
Clause 4
Should the offender be the licensee to provide telephone or communication service or the concessionaire to provide such service, apart from being liable to the punishment as prescribed for the offence under clause 1 or 2, as the case may be, the offender’s license or concession shall also be terminated.
The present Announcement shall come into force as from the date of its publication in the Government Gazette.[1]
