Given on the 18th day of March 2560 BE
Being the 2nd year of the present reign

Somdet Phra Chaoyuhua Maha Vajiralongkorn Bodindradebayavarangkun gives a royal command by which He orders with His pleasure that it be announced as follows:

Whereas it is appropriate to amend the Penal Code;

Therefore, by and with the advice and consent of the National Legislative Assembly, He orders with His gracious pleasure that the following Act be enacted:

Section⁠1.⁠This Act is called the "Act Amending the Penal Code (No. 26), 2560 BE".

Section⁠2.⁠This Act shall come into force from the day following the day of its publication in the Royal Gazette onwards.

Section⁠3.⁠The stipulations of section 99 of the Penal Code shall be repealed and replaced by the following stipulations:

"Section⁠99.⁠As for the seizure of property or attachment of a claim over property to cover a fine or the confinement imposed instead of a fine, if it is not done within a term of five years counted from the day of issuance of the final judgment, it can no longer be done.
The stipulations of paragraph 1 shall not apply in the event that the confinement imposed instead of a fine is done in continuation to imprisonment."

Section 133: "...shall be punished with imprisonment from one year to seven years, or a fine from twenty thousand baht to one hundred and forty thousand baht, or both the imprisonment and the fine".
Section 134: "...shall be punished with imprisonment from six months to five years, or a fine from ten thousand baht to one hundred thousand baht, or both the imprisonment and the fine".

Section 140, paragraph 1: "...shall be punished with imprisonment not over five years, or a fine not over one hundred thousand baht, or both the imprisonment and the fine".
Section 140, paragraph 2: "...shall be punished with imprisonment from two years to ten years and a fine from forty thousand baht to two hundred thousand baht".
Section 190, paragraph 1: "...shall be punished with imprisonment not over three years, or a fine not over sixty thousand baht, or both the imprisonment and the fine".
Section 190, paragraph 2: "...shall be punished with imprisonment not over five years, or a fine not over one hundred thousand baht, or both the imprisonment and the fine".

Section 147: "...shall be punished with imprisonment from five years to twenty years or life imprisonment and a fine from one hundred thousand baht to four hundred thousand baht".
Section 148: "...shall be punished with imprisonment from five years to twenty years or life imprisonment and a fine from one hundred thousand baht to four hundred thousand baht, or death".

Section 149: "...shall be punished with imprisonment from five years to twenty years, or life imprisonment and a fine from one hundred thousand baht to four hundred thousand baht, or death".
Section 150: "...shall be punished with imprisonment from five years to twenty years, or life imprisonment and a fine from one hundred thousand baht to four hundred thousand baht".
Section 151: "...shall be punished with imprisonment from five years to twenty years, or life imprisonment and a fine from one hundred thousand baht to four hundred thousand baht".
Section 152: "...shall be punished with imprisonment from one year to ten years and a fine from twenty thousand baht to two hundred thousand baht".

Section⁠8.⁠The rate of punishment under Section 271 of the Penal Code, which has been amended by the Act Amending the Penal Code (No. 4), 2522 BE, shall be repealed and replaced by the following rate of punishment:

Section 271: "...shall be punished with imprisonment not over three years, or a fine not over sixty thousand baht, or both the imprisonment and the fine".

Section⁠9.⁠The rate of punishment under section 277bis(1) of the Penal Code, which has been amended by the Act Amending the Penal Code (No. 20), 2550 BE, shall be repealed and replaced by the following rate of punishment:

Section 277bis(1): "...shall be punished with imprisonment from fifteen years to twenty years and a fine from three hundred thousand baht to four hundred thousand baht, or life imprisonment".

Section⁠10.⁠The rates of punishment under section 280(1), section 287, section 315, section 320, paragraph 1 and paragraph 2, section 335bis, paragraph 1 and paragraph 2, section 339, paragraph 1, paragraph 2, paragraph 3, and paragraph 4, and section 339bis, paragraph 1, paragraph 2, and paragraph 3, of the Penal Code, which have been amended by the Act Amending the Penal Code (No. 5), 2525 BE, shall be repealed and replaced by the following rates of punishment:

Section 280(1): "...shall be punished with imprisonment from five years to twenty years and a fine from one hundred thousand baht to four hundred thousand baht".
Section 287: "...shall be punished with imprisonment not over three years, or a fine not over sixty thousand baht, or both the imprisonment and the fine".
Section 315: "...shall be punished with imprisonment from fifteen years to twenty years and a fine from three hundred thousand baht to four hundred thousand baht, or life imprisonment".
Section 320, paragraph 1: "...shall be punished with imprisonment from two years to ten years, or a fine from forty thousand baht to two hundred thousand baht, or both the imprisonment and the fine".

Section 282, paragraph 1: "...shall be punished with imprisonment from one year to ten years and a fine from twenty thousand baht to two hundred thousand baht".
Section 282, paragraph 2: "...shall be punished with imprisonment from three years to fifteen years and a fine from sixty thousand baht to three hundred thousand baht".

Section 282, paragraph 3: "...shall be punished with imprisonment from five years to twenty years and a fine from one hundred thousand baht to four hundred thousand baht".

Section 276, paragraph 3: "...shall be punished with imprisonment from fifteen years to twenty years and a fine from three hundred thousand baht to four hundred thousand baht, or life imprisonment".
Section 286, paragraph 1: "...shall be punished with imprisonment from seven years to twenty years and a fine from one hundred and forty thousand baht to four hundred thousand baht, or life imprisonment".

Section⁠14.⁠The rates of punishment under section 310bis and section 312bis, paragraph 1 and paragraph 2(1), of the Penal Code, which have been amended by the Act Amending the Penal Code (No. 13), 2537 BE, shall be repealed and replaced by the following rates of punishment:

Section 310bis: "...shall be punished with imprisonment not over five years and a fine not over one hundred thousand baht".
Section 312bis, paragraph 1: "...shall be punished with imprisonment from three years to ten years and a fine not over two hundred thousand baht".

Section 312bis, paragraph 2(1): "...shall be punished with imprisonment from five years to fifteen years and a fine not over three hundred thousand baht".

Section⁠15.⁠The rates of punishment under section 335, paragraph 1, paragraph 2, and paragraph 3 of the Penal Code, which have been amended by the Act Amending the Penal Code (No. 7), 2530 BE, shall be repealed and replaced by the following rates of punishment:

Section 335, paragraph 1: "...shall be punished with imprisonment from one year to five years and a fine from twenty thousand baht to one hundred thousand baht".

Note: The grounds for promulgation of this Act are as follows: Whereas it is appropriate to designate a time frame for the enforcement of fines, which includes the attachment of claims over property to cover the fines, for the sake of clarity; and whereas the provisions of the Penal Code which relate to the rates of fine are still not consistent with the economic and social condition of the Country at present, making it appropriate to improve the said provisions in line with the prevailing situation; and [whereas] it is appropriate to improve [the provisions on] the offences which carry other criminal punishments than fine by making them punishable by fine also; therefore, it is necessary to enact this Act.
