The United States created a detention camp in its Guantanamo Bay Naval Base to hold captives taken during its war on terror in extrajudicial detention.

Following the Supreme Court ruling in Rasul v. Bush the US Department of Defense was forced to provide the captives an opportunity to hear and attempt to refute the allegations that lead to their detention. The Department of Defense created the Combatant Status Review Tribunal as its attempt to comply with the Supreme Court's ruling.
