Executive Order 865

It is hereby ordered that on and after July 1, 1908, the land within the boundaries shown on the attached diagram, heretofore set apart, reserved, and proclaimed as parts of the Cascade, Fremont, and Umpqua National Forests, shall be known as the Umpqua National Forest. The remaining portion of the present Umpqua National Forest, with the exception of the portions indicated on this diagram and on the diagram of the Siuslaw as eliminations, shall continue reserved and constitute the Siuslaw National Forest. It is not intended by this order to release any land from reservation, except the areas indicated as eliminations, or to reserve any land not heretofore embraced in a National Forest.

The lands hereby excluded from the Umpqua National Forest which are not embraced in withdrawals for administrative sites for use in the management of the Forest, or in any other reservation, or appropriation, shall be restored to the public domain and become subject to settlement under the general provisions of the homestead laws on such date and after such notice by publication as the Secretary of the Interior may prescribe, but shall not become subject to entry, filing, selection, or other form of appropriation until the expiration of thirty days from the date so fixed, and no person will be permitted to gain or exercise any right whatever under any settlement or occupation begun prior to such date, and all such settlement and occupation are hereby forbidden.
