§§ 7733-7739

§ 7733. Civil remedies not affected. The omission to specify gins, or affirm in this code, any liability to any damages, penalty, forfeiture or other remedy, imposed by law, and allowed to be recovered or enforced in any civil action or proceeding, for any act or omission declared punishable herein, does not affect any right to recover or enforce the same.

§ 7734. Proceedings to impeach or remove. The omission to specify or affirm in this code any ground of forfeiture of a public office or other trust or special authority conferred by law, to impeach, remove, depose or suspend any public officer or other person holding any trust, appointment or other special authority conferred by law, does not affect such forfeiture or power, or any proceeding authorized by law to carry into effect such impeachment, removal, deposition or suspension.

§ 7735. Military or other authorized punishment. This code does not affect any power conferred by law upon any court martial or other military authority or officer to impose or inflict punishment upon offenders; nor any power conferred by law upon any public body, tribunal or officer, to impose or inflict punishment for a contempt; nor any provisions of the laws relating to apprentices, bastards, disorderly persons. Indians and vagrants.

§ 7736. Fines go to state school fund. All fines, forfeitures and pecuniary penalties, prescribed as a punishment, by any of the provisions of this code, when collected, shall be paid into the treasury of the proper county, to be added to the state school fund.

§ 7737. Costs taxed and collected. In all cases of conviction, the costs of the prosecution shall be taxed against the defendant, and enforced as other judgments in criminal causes.

§ 7738. Code construed. Continuation of existing statutes. The provisions of this code so far as they are the same as existing statutes, must be construed as continuations thereof and not as new enactments.

§ 7739. This code not retroactive. Exceptions. The provisions of this code shall not apply nor extend to any act done or offense committed prior to the taking effect hereof, except as specially provided herein; but the provisions of law now in force, and applicable to the crime to which this code relates as well in respect to the penalty affixed as in all other respects (except matters of procedure, and any provisions alleviating the punishment to be imposed upon conviction in any case ), shall hereafter be and remain in full force and effect as to any such offense committed before the taking effect of this code.
