Aliens than not CAP. XVIII. An Adt for the Encouraging and Increafing of Shipping and Navigation.^ ' in^OR the Increafe of Shipping and Encouragement of the Navigation of this Nation, wherein, under _ ' 1} the good Providence and Protection of God, the Wealth, Safety and Strength of this Kingdom is . ' fo much concerned;' (2) Be it enadled by the King's moft Excellent Majefty, and by the Lords and Commons in this prefent Parliament aflembled, and by the Authority thereof. That from and after the fiift Day of December one thoufand fix hundred and fixty, and from thenceforward, no Goods or Com- modities whatfoever (hall be imported into or exported out of any Lands, Iflands, Plantations or Terri- tories to his Majefty belonging or in his Poffeflion, or which may hereafter belong unto or be in the Poffeffion of his Majefty, his Heirs and Succeflbrs, in Afia, Africa, ox America, in any other Ship or Ships, VeiTel or Veflels whatfoever, but in fuch Ships or Veflels as do truly and without Fraud belong only to the People oi England or Ireland, Dominion oi Wales or Town oi Berwick upon Tweed, or are of the Built of and belonging to any the faid Lands, lilands, Plantations or Territories, as the Proprietors and right Owners thereof, and whereof the Mafter and three fourths of the Mariners at leaft are Englijh ; (3) under the Penalty of the Forfeiture and Lofs of all the Goods and Commodities which fhall be imported into or exported out of any the aforefaid Places in any other Ship or Vefiel, as alfo of the Ship or Veffel, with all its Guns, Furniture, Tackle, Ammunition and Apparel ; one third Part thereof to his Majefty, his Heirs and Succeflbrs; one third Part to the Governor of fuch Land, Plantation, Ifland or Territory where fuch Default fhall be committed, in Cafe the faid Ship or Goods be there feized, or otherwife that third Part alfo to his Majefty, his Heirs and Succeflbrs ; and.the other third Part to him or them who fliall feize, inform or fue for the fame in any Court of Record, by Bill, Information, Plaint or other Ac- tion, wherein no Eflbin, ProteAion or Wager of Lawftiall be allowed ; (4) and all Admirals and other Commanders at Sea of any the Ships of War or other Ship having Commiffion from his Majefty or from his Heirs or Succeflbrs, are hereby authorized and flridtly required to feize and bring in as Prize all fuch Ships or Vefl^els as fhall have offended contrary hereunto, and deliver them to the Court of Admiralty, thereto be proceeded againft; and in Cafe of Condemnation, one Moiety of fuch Forfeitures (hall be to the Ufe of fuch Admirals or Commanders and their Companies, to be divided and proportioned amongft them according to the Rules and Orders of the Sea in Cafe of Ships taken Prize ; and the other Moiety to the Ufe of his Majefty, his Heirs and Succeflbrs. n. And it is further enacted by the Authority aforefaid.
