And for eJabliJJiing the Form of ?naking, ordaining, and confecrating of Bijhots, Priefls, and Deacons in the Chti-.-ch «/ England, for officiating in any Congregation for the Exercife of Religion permitted and allowed by this A(ft. IX. Provided always, That the making and fubfcribing the faid Declaration, and the taking the faiJ Oaths, and making the Declaration of Approbation and bubfcription to the faid Articles, in Manner as aforefaid, by every refpeftive Perfon or Perfons herein before- mentioned, at fuch Genera! or Quarter Seffior.s of the Peace as aforefaid, (hall be then and there entred of Record in the fjid Court, for which fix Pence fhall be paid to the Clerk of the Peace, and no more : Provided that fuch Perfon fhall not at any Time preach in any Place, but with the Doors not locked, barred, or bolted, as aforefaid. ' X. And whereas fome Diflenting Protellants fcruple the Baptizing of Infants;' be it enaded by the Authority aforefaid. That everi/ Perfon in pretended holy Orders, or pretending to holy Orders or Prea- cher, or Teacher, that fhall fubfciibe the aforefaid Articles of Religion, except before excepted, and except Parr of the feven and twentieth Article touching Infant Baptifin, and fnall take the faid Oaths and make and fubfcrihe the, Declaration aforefaid, in Manner aforefaid, every fuch Perfon fhall enjoy alf'the Privileges, Benefits, and Advantages, which any other Diflenting Minifter, as aforefaid, might have or en- joy by Virtue of this A.&.. XL And be it further enabled by the Authority aforefaid. That every Teacher or Preacher in holy Orders or pretended holy Orders, that is a Minifter, Preacher, or Teacher of a Congregation, that ftial] take the Oaths herein required, and make and fubfcribe the Declaration aforefaid, and alfo fubfcribe fuch of the aforefaid Articles of the Church ofE?iglaiid, as are required by this Aft in Manner aforefaid, {hall be thence- forth exempted from ferving upon any Jury, or from being chofen or appointed to bear the Office of Churchwarden, Overfeer of the Poor, or any other parochial or Ward Office, or other Office in any hundred of any Shire, City, Town, Parifh, Divifion, or Wapentake. XII. And be it further enaded by the Authority aforefaid. That every Juftice of the Peace may at any Time hereafter require any Perfon, that goes to any Meeting for Exercife of Religion, to make and fub- fcribe the Declaration aforefaid, and alfo to take- the faid Oaths or Declaration of Fidelity herein after- mentioned, in cafe fuch Perfon fcruples the taking, of an Oath, and upon Refufal thereof, fuch Juftice of the Peace is hereby required to commit fuch Perfon to Prifon without Bail or Mainprize, and to certify the Name of fuch Perfon to the next General or Quarter Seffions of the Peace to be held for that Count' City, Town, Part, or Divifion, where fuch Perfon then refides ; and if fuch Perfon fo committed fliall upon a fecond Tender at the General or Qiiarter Seffions refufe to make and fubfcribe the Declaration aforefaid, fuch Perfon refufmg fhall be then and there recorded, and he fliall be taken thenceforth to all Intents and Purpofes for a Popifa Recufant ConviiSf, and fufier accordingly, and incur all the Penalties and Forfeitures of all the aforefaid Laws. ' . XIII. And whereas there are certain other Perfons, Diffenters from the Church of England, who fcruple ' the taking of any Oath ;' be it enadled by the Authority aforefaid. That every fuch Perfon fhall make and fubfcribe the aforefaid Declaration, and alfo this Declaration of Fidelity following, viz. A. B. do fmcerely promife and folemnly declare before God and the World, that I will be true and faithful to King William and Queen Alary^ ; and I do folemnly profefs and declare, that I do from my Heart abhor, deteft, and renounce, as impious and heretical, that damnable Doftrine and Pofition That Princes excoryimunicoted or deprived by the Pope, or any Authority of the See of Rome, may he depofed or murthered by their Sitbje£ls, or any other tvhMfaever. And I do declare, that no Foreign Prince Perfon

  • Prelate, State, or Potentate, hath or ought to have, any Power, Jurifdifl-ion, Superiority, Pre-eminence'
  • ^ or Authority Ecclefiaftical or Spiritual within this Realm.' '

And fliall fubfcribe a Profeffion of their Chriftian Belief in thefe Words : A. B. profefs Faith in God the Father, and in Jefus Chrifl his Eternal Son, the true God, and in the _ Holy Spirit, one God blefled for evermore ; and do acknowledge the Holy Scriptures of the Old and New Teftament to be given by Divine Infpiration.' Which Declarations and Subfcription fhall be made and entred of Record at the General Quarter SefSons of the Peace for the County, City, or Place where every fuch Perfon fhall then refide. And every fuch Perfon that fhall make and fubfcribe the two Declarations and Profeffion aforefaid, being thereunto required, ftiall be exempted from all the Pains and Penalties of all and every the aforementioned Statutes made awainfl Popiili Recufants, or Proteftant Nonconformilts, and alfo from the Penalties of an Aft made in the fifth Year of the Reign of the late Queen Elizabeth, intituled. An Ail for the Affurance of the ^een's Royal Power over all Eflates and SubjeSis within her Dominions, for or by reafon of fuch Perfons not takino- or refufing to take the ©ath mentioned in the faid Aft ; and alfo from the Penalties of an Aft made in the^thirteenth and- fourteenth Years of the Reign of King Charles the Second, intituled^ An ASi for preventing Mifchiefs that- 13 Sc 14 Car.
