That it ihall and may be lawful for '^^^ ' any one or niore Juftice or JufHccs of the I'eace of the Place or Divifion where any new Streets or Ways are or ihall be made, horn time to time to view and infpecl the fame ; and if upon fuch View they fhall judge them fit to be paved or otherwife amended, to certify the fame under their Hands to the Juliiccs of the Peace, at the next refpective CJeneral Qiiarter-Seffions of the Peace for the Place where fuch Streets or Ways are or fliall be made, v/ho are hereby re'peclively thereupon authorized and required to take fuch Order for the paving or oth;rvvifc amending the fame, as they fhall think fit. And all and every Per- fon and Perfons, Owners and Inabitants of all and every the Houfes new built,, or hereafter to be built, or adjoining to any new Streets or Ways adjudged to be paved or amended, fhall, and are hereby required, according to their feveral and refpective Interelts therein, by Order of fuch Juftices at their Seffion, and by a Time m fuch Order limited, pave ivith Stone or Gravel, or othcrwife amend, all the Ground that doth or fhall lie in Front before every Dv/eUing-houfe or other Buildings in fuch Streets and Ways, extended Penalty. . to the Middle of the Way that doth or fhall lie bsfore tha fame : And every Perfon offending herein, or that fllall not from time to time repair ai^l amend his or her Proportion of the Pavements in fuch Streets and Ways where they fhall be paved, fliall forfeit forty Shillings for every fuch Offence or Default for every Perch, and after that Rate for a greater or lefTer Qiiantity, and the like Sum for every Week, till the fame be paved, or amended and repaired, and when paved or amended, the like Sum as thofe that fhall not pave and repair open Streets, Lanes, and Alleys, nov/ paved by virtue of this Aft. Provided always, That fuch anci.nt Streets, Lanes, and Alleys within the faid Places, or any as toinierly. of thern, as by Cuftom and Ufage have been repaired and paved by any oiher Order, or in any other Man- ner, fhall be hereafter repaired, paved, and maintained in fuxh Sort and Manner, and by fuch Perfon and Perfons as have heretofore ufed to repair, pave, and maintain the fame, under the Penalties aforefaid; any thing in this Act contained to the coiitrary thereof in any wife notwithftanding. Charges of I^- And for the better raifing and levying of Monies to defray the Charges, and pay the Wages of cleanfing how the faid Scavengers, Rakers, and other Of&ccrs employed in cleanfing of the Streets, and other Places raifed. aforefaid, and carrying away the faid Afhes, Dirt, Filth,' and Soil; Be it further enaiSed by the Authority aforefaid, That within the Pariflies of Saint Jnne and Saint James, within the Liberty of tVeJhn'inJhr, the Scavengers, Rakers, and fuch like Officers, {hall be chofen a? by the faid refpe£tive A(9:s is direfted and I Salk. 356. appointed : And the Rates, Taxes, and Affeffments for Scavengers, Rakers, and fuch like OfEcers Wages for cleanfing the Streets, lliall be rated, taxed, and aflefled, raifed, and paid by the Parifhioners and In- habitants of thofe refpe£five Parifnes, according to the Cuftom and Ufage of the faid City, where it is not otherwife in the faid Acts provided and enaifted : And the Receivers of all fuch Monies fhall be account- able in, fuch Manner as they no.v are by the faid A£ts, or otherwife by the Law in cafe there is no Provifion for the fame thereby appointed : And all nev/ Mefluages, Tenements, and Houfes, now, or at any Time hereafter built and erected within the Limits and Pariflies aforefaid, fliallbe likewife rated, taxed,, and aflefled, and fhall pay proportionable with others. And in all other Places and Pariflies aforefaid, upon ■f^tSuon of ^ic^-cvtry Moiiday or Tucfday m Eajhr Wiek, the Conftables, Churchwardens, and Overl'eers of the Poor, and' venders., and Pu- Surveyors of^ the Highways of every of the faid Parifhes and Places refpeclively, or the greater Number of nifliment of Re- j.jjgj^^ giving Notice unto, or calling together, fuch other ancient Inhabitants of their refpeftive Parifhes, " "^' as according to the Cuftom of the faid Pariflies or Places are ufually prefent at the Eleftion of Parifh Officers, they, or the greater Number of them prefent, fhall make Choice of, and fhall nominate and ap- foint, two or more able Perfons, that are Tradefmen of their Parifh, to be Scavengers for the Streets, vanes, and Alleys, and other open Paffages of each Ward and Divifion within their faid Parifh for the Year then next enfuing, and until others be chofen and fettled in their Places; which Perfons fo chofen, and being approved and confirmed under the Hand of any two Juftices of the Peace within their refpedive Limits and Jurifdidtions, fhall within feven Days after their £le£lion and Confirmation, and Notice thereof, take that Office and Duty upon them, upon Pain to forfeit ten Pounds for every Refufer refpecftively ; and in cafe of Refufal by any Perfon or Perfons fo chofen and confirmed, then other able Perfons ihall be chofen and confirmed in Manner aforefaid, within feven Days after fuch Refufiil, in the Place of him or them which fhall fo refufe ; and the Perfon or Perfons fo chofen and confirmed, and having Notice the:-eof, fhall undergo the like Pain of ten Pounds in cafe of Refufal, or not taking upon him or them the faid Office or Duty within feven Days after he or they fhall be chofen and confirmed, and have Notice thereof, as aforefaid. The faid Penalties to be paid to the Surveyors of the Highways of the Place, and difpofed of and employed by them for and towards the mending and repairing of the Highways and Streets of the fame Parifh, Ward, or Divifion, and to be levieid by Diffrefs and Sale of the Goods and Chattels o: the Offenders, by Warrant under the Hand and Seal of any one Juftice of Peitce of any of the Places afore- faid, to be directed to the Conftables or other Officers of the fame Parifh, or any two or more of them, rendring the Overplus to the Party (reafonable Charges for the Diftrefs only to be dedufted) and in De-. fault of Diftrefs or Non-payment within fix Days after Demand thereof, or Notice left in Writing at the Houfe or Dwelling-place of the Offender, by the faid Conftables or Officers refpeftively, the hva- Offender to be committed to the Common Gaol of the faid County, City, or Place refpeftively, by the Warrant of any fuch Juftice under his Hand and Seal, there to remain without Bail or Mainprize, until Payment be thereof made as aforefaid ; and To in like manner for every Perfon or Perfons negleding oi reiufing the fame.
