King Henry the Fifth, intituled. Keels that carry CoaU at Newcaftle, jhall he ineafiircd and marked; ' - ■ ■ and the other in the thirtieth Year of our late Sovereign Lord King Charles the Second, intituled, yf« A^f 30 Car. i. flat. 1. for the Admcajurc}ne7tt of Keels atid Boats carrying Coals ; for the Remedy of Deceits therein complained of c. 8.J (amongft other Things) it was thereby enaAed, That Commifiioners fhould from Time to Time be' ap- pointed by His faid late Majefty, His Heirs and SuccefTors, for the admeafuring and marking all and every ' the Keels arid other Boats, and Wains, and Carts ufed, or in any Time thereafter to be ufed, for the Car- riage of Coals in the Port of Newcafile upon Tyne., Sunderland upon the RiVer Weare, Culler-coates, Seaton- ' Jlvjce^ Blyth-?iook, and all and every of the Members, Havens, Creeks, and Places whatfoover, to the faid " Port oi NewcajUe belonging, upon the Forfeiture that every Keel, Boat, Wain, or Cart, which fliould . , thereafter carry Coals in any of the aforefaid Places, before they fhall be admeafured and marked, as afore- faid, fhould be forfeited, together with the Coals laden upon them : Notwithflanding which, divers new Frauds, Deceits and Abufes have of late arifen, and are' daily praclifed, to the Diminution of His Maje- fty's Culloms, and the great Prejudice and Damage of the Buyers and Sellers of Coals;' For Remedy, whereof, ; . II. Be itenaiEled by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Commiffiohers Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the '<> be »pppinR<J fame. That Commiflioners fhall from time to time be appointed by His Majefty, His Heirs;ancl SuccefTprs,' ^/^J^"'^ ^" for the admeafuring and marking all and every the Keels, Pau-keels, and Pan-boats, and other Boats, and n,e5J^of"Kcels Wains, and Carts ufed, or in any Time hereafter to be ufed, for the Carriage of Coals in the Port of in Newcaftle, Newcajlle upon Tyne^ Sunderland upon the River TVeare, Culler-coatei., Seaton-Jlidce-, Blyth-tiook, and all other &c. Places within the Counties of A'i?-//;z.'OTZ'i'r/i7;;i'/ and Durham, and all and every the Members, Havens, Rivers, nG-oo. s. c.15-. Creeks and Places vvhatfoever, to the faid Port oi Neivcajile, and Counties aforefaid belonging ; which faid J" *• Admeafurement fliall be by a dead Weight of Lead or Iron, or otherwife, as fhall feem meet to the faid Commiffioners, or any three of them, allowing three and fifty hundred Weight to every Chaldron- of ' Coals ; which faid Keels, Boats, Wains, or Carts, fhall be admeafured and marked at the Times and Places and in manner hereafter mentioned ; any thing in the faid former A£t:s to the contrary notwithftanding. in. Provided always, That the Weight or Contents of Coals, loaden or carried by every fuch Wain, The Content cf fhall be of the Weight or Content of feventeen hundred V/eight and an Half; and the Weight or Contents aCattLoad, &c. of Coals, loaden or carried by every fuch Cart, fliall be of the Weight or Content of eight hundred and three Quarters ; and that three fuch Wains, or fix fuch Carts, fhall be reckoned and allowed for one Chaldron, and no more, and that no other Wains or Carts are hereby intended to be admeafured or mark- ed, but only fuch Wains and Carts as are now or hereafter fhall be employed in carrying Goails, to th«  Staiths, to be directly put from the Staiths into the Ships, and no others. ',■ ': . ' ; . IV. And be it further enatced by the Authority aforefaid. That the faid Commiflioners, or any three Carts and Keels' or more of them, fhall caufe all and every of the faid Keels, Boats, Wains and Carts to be admeafured ac- ^° ^^ meafurcd cordingly ; and fliall give three Days Notice of the Time and Place of fuch Admeafurement to the Own- ^q^^"^-'^^^ er or Owners thereof, and caufe the faid Keels and Boats fo admeafured, to be marked and nailed on each, ""'■'" ■w^V Side the Stem and Stern and Midfhip thereof, or otherwife as they the faid Commiffioners, or any three of them, in their Difcretions fliall direiSt; and the faid Wains and Carts to be marked and nailed on the Head and Sides of the faid Wains, Carts, or otherwife, as- the faid Commiflioners, or any Three of them, fhall dirciR:, or by fuch Perfons as fhall be by them thereunto appointed ; which Perfons fo appointed fhall take an Oath before the faid Commiffioners, or any three of them, for the true and impartial Performance and difcharging the fame ; which Oath the faid CommiiTioners are hereby impowered to adminifter : And if the Owner or Owners of fuch Keels or Boats, Wains or Carts, fhall after fuch Notice negleiSl or refufe to have their faid Keels, Boats, Wains or Carts fo admeafured, they and every of them fhall incur the Pe- nalty hereafter mentioned. V. Provided, That no fuCh Keel or Boat be admeafured, marked or nailed, but between the five and Content of » New Key of the faid Port, and that the Keels and Bolts belonging to the River JVeare fhall be admeafured, marked and nailed at Lambton Staiths, upon the faid River, and i-iot elfewhere ; and that all the Keels and Boats belonging to Culler-coates, Scaion-Jluice, Blyth-nook, and all other Places within the faid Counties of NorthuTrd'cr'land and Durham, as alfo all Wains and Carts, to be admeafured and marked by virtue of tliis Act, fhall be admeafured and marked at fuch Times and Places as the faid Commiflioners or any Three of them fhall direft. VI. And be it further enacted by the Authority aforefaid. That every Keel, Boat, Wain or Cart, which Keel, &c. no; from and after the Four and twentieth Day o(Jidy, v/hich fliall be in the Y"ear of Our Lord, one thoufand marl-t-d for- fix hundred ninety and five, fliall carry any Coals in any of the Places aforefaid, before they "fliall be ad- !^"""'- meafured, marked and nailed as aforefaid, by three Commiffioners or more of them, fliall be and are here- by declared to be forfeited, together v/ith the Coals that fliall be laden upon them (imlefs the fame fliall happen by Default of the faid Commiffioners) ; one Moiety, of all which forementioned Forfeitures fliall be to the King's Majefty, His Pleirs and-Succefibrs, the other Moiety to him or them that fhall difcover and 4 E 2 ' fue
