Orders by Jufli. ces of Peace to be regiftred in Scflions, and continue for 7 Years, Locks, &c. to be in the Coun- ty where they pay to the Poor Commiflioners made by 21 Jac, ij c. ji. ftill to have the fame Power betwixt Bcrcott and Ox- ford, Wiks, Gkucejfer, Oxford, Berks, and Bucks, within their refpeftive Counties for ever hereafter fliall fife and are hereby declared to be Commiflioners for the putting in Execution the Powers and Authorities herein after mentioned (that is to fay) The faid Commiffioners, or any five of them, fhall have full Power and Authority, from time to time, at their refpeiSive General Quarter-Seffions of the Peace, upon due Exami- nation of the Matter in Controverfy, upon Oath, to make Orders and Conftitutions for fettling and afcg:- taining reafonable Rates and Prices to be taken from the Owners of all Barges, Boats or VefTels, by the Tenants or Occupiers of all fuch Locks, Wears, Bucks, Winches, Turnpikes, Dams, Floodgates, or other Engines, within their faid refpeftive Counties, for the Help and Afliftance which fuch Barges, Boats, or Veflels may or fhall receive thereby, or by Means thereof, in their Paflage upon the faid Rivers, Regard being had, as well to the ancient Rates which have been taken, as the neceflary Charges of repairing (uch Locks, Wears, Bucks, Winches, Turnpikes, Floodgates, and other Engines; and alfo to conftitute ana appoint all fuch other neceflary Rules and Orders concerning the faid Navigation, and alfo concerning fuch Locks, Wears, Bucks, "Winches, Turnpikes, Dams, Floodgates, or other Engines, within their faid re^- fpe£live Counties, and the (hutting, penning, opening, drawing, Ufe or Management thereof, for the Be-; nefit and Safety of the faid Navigation, and concerning all Barges, Boats, or Veflels palling by, through, of with the Help of the fame, and the Behaviour of all Bargemen, Boatmen, and Watermen belonging to or working in fuch Barges, Boats, or VeflTels, fo as to prevent fuch Abufes which have been frequently here- tofore committed by them in the Navigation, as to the faid Commiffioners, or any five of them, fhall feem meet. in. And be it further enaiSted by the Authority aforefaid, That from and after the faid firfl: Day of May,f the faid Juftices of the Peace, or any five of them, in their refpeftive General Quarter-Seflions next after EaJier'Ddiy yearly, fhall have Power and Authority, and they are hereby enjoined and required, to aflefs and rate the Prices of the Carriage of all Sorts of Goods whatfoever, from any Place in their faid refpediiv< Counties, to any other Place or Places upon the faid Rivers, in fuch Boats, Barges, or Veflels, and fha" give publick Notice in Writing to the Mayor or other Head Officer in every Market Town within their fai refpeftive Counties, of the Rites and Prices fo fet and aflefl'ed, and of all other Rates and Prices, whid, fliall be rated and aflefled by viriue of this A6i;: And if any Owner or Proprietor of any fuch Barge, Boat,' orVeffel, fhall, at any Time after fuch Notice, take for the Water-carriage of any Goods or Merchandizes above the Rates and Prices fo fet 'as aforefaid, or if any Perfon or Perfons whatfoever fhall break or aft contrary to any Rules, Orders, or Conftitutions, which fhall be made in Purfuance of this ASt, every fuch Perfon fo oflrending fhall for every Offence forfeit the Sum of five Pounds, to be recovered by the Party grieved, with double Cofls of Suit, in any Adfion of Debt, Bill, Plaint, or Information, to be commenced or profecuted in any of His Majefly's Courts of Record at Weflminjler, wherein no Efl^oin, Prote<5lion, or Wager of Law, fhall be allowed. I^. Provided neverthelefs, and be it enacted by the Authority aforefaid, That if any Perfon or.Perfonsi whatfoever fhall be aggrieved by reafon of any fuch Rules, Orders, Conftitutions, or Afl"eflfrnen'ts, fo as aforefaid to be made by the faid Commiffioners, or any five of them, it fhall and may be lawful to and for the Juftices of Affizeofthe faid County o^ Oxford, for the time being, upon Complaint made by fuch Per- •fon or Perfons grieved, within the Space of one Year next after the making of fuch Rules, Orders, Con- ftitutions, or Afl"efl"ments, to confirm, vacate, or alter the fame, in fuch Manner as fhall be thought moft convenient. V. Provided alfo, and be it further enabled by the Authority aforefaid. That all fuch Rules, Orders, Conftitutions, and Afleflments, other than of the Rates for Carriage, which fliall be made by the faid Com- miffioners, or any five of them, in Purfuance of this A£t, flial! be written in Parchment, and figned by the faid Commiffioners, or any five of them, and be kept amongfl the Records of the Seffion of the Peace of that County within which the fame fliall be made; and the (aid Rules, Orders, Conftitutions, and Af- feflments, other than of the Rates for Carriage, fo figned by the faid Commiffioners, or confirmed or alter- ed on fuch Appeal as aforefaid, fhall continue in Force from the making the fame by the faid Commiffio- ners, or the Confirmation or Alteration thereof by the faid Juftices of Affize, for Seven Years, and from thence until fome new Order, Rule, Conftitution, or Afltflment, fhall be made in the fame Cafe by the faid Commiffioners, or any five of them, every which new Order, Rule, Conftitution, or Afleflment, (hall be fubjedf to the like Appeal, as aforefaid. VI. Provided always. That if at any Time after the faid firft Day of May, any Doubt fhall be made • amongft the faid Commiffioners, in what County any fuch Locks, Wears, Bucks, Winches, or other En- gines are or fhall be, then, and in every fuch Cafe, for preventing of all fiich Difputes, every fuch Lock, Wear, Buck, Winch, or other Engine, fliall be adjudged and taken to be in that County, and fubjeft to the Jurifdiiition of the Commiffioners of that County, within which the fame are taxed or rated to the Church or Poor. VII. Provided alfo, That nothing herein contained fhall be conftrued to give any Manner of Jurifdic- tion to any of the faid Commiffioners, to put in Execution any of the Powers or Authorities hereby grant- ed or direfled, between the faid Village of Bercott and the City of Oxford, nor to repeal or impeach the Powers or Authorities granted to the Commiffioners in and by an Aft made in the one and twentieth Year of the Reign of King James the Fiift, intituled, An Ji^ for making the River of TYrumts navigable for Barges, Boats, and Lighters, from the Village of ^evcotl in the County ij/" Oxford, unto the Univerjit , and City of Oxford; but that the faid Commiffioners or the more Part of them, by virtue thereof and of this Ai5f, fliall have Power and Authority from time to time, with fuch Confent as in the faid firft recited A<£1 is re- quired, to ordain and make Orders and Conftitutions for the good and orderly Ufage of the Paflage by Wa- ter on the River of Thames, betwixt the City oi' Oxford and the Village of Bsrcott, and for all Locks, Wears, or Turnpikes thereof, made or to be made, and maintained at the Charge of the Univerfity and City of Or- _/«r«?, or otherwife, and for the Reparation and Amendments thereof; and for all Boats, Boatmen, Paflengers, 4 Wharfs,
