C. 22. 2^ paid, as aforefaid, after the Rate of feventy-five Pounds Weight to the Bufhel, and for every Bufhel of fuch refined Salt made from Rock Salt or Salt Rock, whereof the Duties fhall have been charged and paid or allowed, after the Rate of fifty-fix Pounds to the Bufliel, the Duties which fhall have been fo paid for every Such Buftiel of Rock Salt, Salt Rock, or refined Salt, fo exported, to the Perfon or Perfons ex- porting the fame, by the Officer or Officers appointed to colleft the Duties on Salt in the fame Pert from whence any fuch refined Salt fhall be exported within two Days after Demand thereof, on a Deben- ture to be prepared by the Colleftor of the Cuffoms in the Port where fuch Rock Salt, Salt Rock, or re- fined Salt fhall be entred out for Exportation, and verified by the Perfon executing the Office of Searcher ixpirter to in fuch Port, as to the Quantity of fuch Rock Salt, Salt Rock, or refined Salt aftually fliipped ; and that make Oath that the Oath of the Exporter, or his Agent, be firfl taken before the principal Officers of the faid Port, be- " j*"^" "°'.'"= fore the Debenture be allowed, who are hereby required and impowered to give the faid Oath, That the -^^^^^^ ^^ Duties, as aforefaid, for the Rock Salt, Salt Rock, or refined Salt, in fuch Debenture mentioned, were firfl a£tually paid, and that fuch Rock Salt, Salt Rock, or refined Salt is really exported, or {hipped to be exported, to Parts beyond the Seas, and not intended to be re-landed in England, IVaks, or Berwick ; for which Debenture no Fee or Reward fhall be taken : And in Cafe the Officer, hereby directed to pay ' Explained by fuch Debenture, fhall not have fufficient Money in his Hands to pay the fane, then upon Certificate 2 & 3 Anna:, thereof by him made (which Certificate he is hereby required to give the Party ^;-£?//V, and without Delay) <^- '4- §• 9- ^s the principal Commiffioners for managing the Revenue of Excife of his Majefty, his Heirs and SuccelTors, 'oScotrnd"&c * for the Time being, fhall be chargeable with the faid Payment, to be made out of the firfb Money in their ' Hands arifing out of the Duties upon Salt, and any Officer negle£ting or refufing to pay the faid Money, Penalty on Offi- or to give. fuch Certificate as he is hereby direfted, fhall forfeit double the Sums fo to be paid, to the Party "■■ refufing to grieved, to be recovered by Aftion of Debt, Bill, Plaint, or Information, wherein no EiToin, Protection, P^^" or Wager of Law fliall be allowed. VIII. And be it enaded by the Authority aforefaid, that the Duties upon Rock Salt and Salt Rock, Duties how to which fhall be charged in purfuance of this Aft, fhall be raifed, levied, and recovered, by fuch Ways and ^^ "ifed,&c. Means, and in fuch Manner and Form, in all Cafes (unlefs in fuch where other Methods or Dircttions are hereby prefcribed) as the Dutiies upon Salt or Rock Salt, chargeable by the faid former Adts, or any of them, were thereby appointed to be raifed, levied, and recovered ; and that all Fines, Penalties, and And Fines, Pe- Forfeitures, by this A£l impofed, fhall and may be fued for, levied, and recovered, in fuch Manner and nalties, &c. re- Form, and with fuch Power of Mitigation, as any Fine, Forfeiture, or Penalty, is or may be recovered, <=°'"™' by any Law or Laws of Excife, or by Aftion of Debt, Bill, Plaint, or Information in any of his Majefly's Courts of Record at Weflminjler ; and that one Moiety of every fuch Fine, Forfeiture, or Penalty, fhall be to his Majefty, his Heirs and SuccefTors, and the other Moiety to him or them that fhall inform or' fue for the fame ; and that all the Duties which fhall be charged by Virtue of this Aft, as afore- faid, fliall be brought in, applied, ilTued, and difpofed of, to the fame Ufes and Purpofes, and in the fame Proportions, as the Duties upon Salt and Rock Salt, charged by the faid former Afts refpsc- tively, are appointed to be brought in, iffued, and applied, and under the fame Penalties for delaying, diverting, or mifapplying any Part of the Monies arifing for the faid Duties to be charged by this Aft, as in and by the faid former Afts, or any of them, in the like Cafe and Cafes are prefcribed ; any Thing in this or the faid fonner Afts contained to the contrary thereof in any wife notwith - flanding. IX. And for the greater Equality, in determining Differences touching the Duties upon all Salt whatfo- ever, and the Penalties and Forfeitures concerning the fame ; be it further enafted by the Authority aforefaid. That from and after the fifteenth Day of A'lay in the Year of our Lord one thoufand fix Perfons aggrierel hundred ninety-nine, if any Perfon or Perfons fhall find him, her, or themfelves aggrieved by any "'3' ='PP"i. Order or Judgment of any two Juflices of the Peace, relating to the Duties upon Salt, or to any For- feiture or Offence concerning the fame, that then it fhall and may be lawful to and for fuch Perfon or Perfons to appeal to the Juftices at the next Quarter-Seffions of the Peace to be holden for that County, Liberty, Riding, Divifioji, or Place, where the faid Order or Judgment fhall be made or given, and the faid Juftices at fuch Quarter-SefEons are hereby impowered and authorifed to hear and determine the fame, whofe Judgment therein fnall be final ; any Thing in this or any former Aft or Afts to the con- trary notwithflanding. X. And be it enafted by the Authority aforefaid. That from and after the faid fifteenth Day of j^iiy AH Salt whatfo- in the Year of our Lord one thoufand fix hundred ninety and nine, all Rock Salt, and Salt Rock, and ever to be we.gh- white Salt whatfoever, that fhall be fliipped or taken on board any Ship, Boat, or VefTel whatfoeyer, to ^ereftippe"' be delivered as a Commodity, either to be exported to Irdand^ or any other Place beyon=d the Seas, or to be unladen in any Port, Creek, Haven, or other Place, on the Coafls of England, or eifewhere, fhall be weighed at the Place or Creek where the faid Salt is to be taken on hoard, by fuch Officer or Officers, as the Commiffioners of the Excife, or the major Part of them for the Time being, fhall from time to time direft and appoint; and that no fuch Salt fhall be carried on board any Ship, Boat, or Veffel whatfoever, and not p«t on till the fame fhall be fo weighed or tendered to be weighed, and a Permit or Certificate, containing the board tiUweigk- Qiiantity of fuch Salt fo weighed or tendered to be weighed, as aforefaid, be firff haxl ajid obtained, under ed, and Pejmit the Penalty of forfeiting the faid Salt, not fo weighed or tendered to be weighed, and over and above ten <*"'"e'^- Shillings per Bufhel,^for the fame, and after that Rate for a greater or leiler Quantity, to his Majefly, ^'enalty. his Heirs and SuccelTors, fo carried on board any Ship, Boat, or Veflel, contrary to the true Intent,and Meaning hereof; which faid Permit or Certificate fuch Officer fhall give to the Party requiring the fame Officer to give gratis, on the Penalty of Eve Pounds to the Party grieved, i^"^^ gratis.
